Court won't hear appeal from condemned soldier

The Supreme Court won't hear another appeal from an Army private who had been sentenced to death under military law for killing two Texas taxi drivers.
The high court on Monday refused to hear an appeal from Dwight J. Loving. Loving was convicted in military court of killing two men during separate robberies on Dec. 11, 1988 in Killeen, Texas. Loving was stationed at Fort Hood.
His death sentence was upheld by appeals courts and by the Supreme Court in 1996.
He wanted the Supreme Court to throw out his death sentence because military courts waited almost 19 years before holding a hearing on whether Loving's lawyer did everything possible to mitigate his death sentence.
The case is Loving v. United States, 09-989.
