An 89-year-old man charged with fatally beating his 86-year-old roommate at a Buffalo-area assisted living facility has died.

Chester Rusek's attorney says he died Wednesday in the lockup at Erie County Medical Center, where he was being treated for medical problems.

Rusek was charged with manslaughter in the November 2012 killing of Salvatore Trusello. Authorities say Rusek used a 2-pound magnet to pummel Trusello as he lay in his bed at a senior living community in the town of Tonawanda. Trusello died a month later.

Rusek's lawyer, Barry S. Dolgoff, tells The Buffalo News (http://bit.ly/1yRCXsb) that once a death certificate is filed, prosecutors will ask an Erie County judge to dismiss the charges.

Investigators say Rusek beat Trusello because he believed his roommate was stealing from him.
