Judge tosses civil case against Chicago officer in shooting

A U.S. judge has tossed a civil case against one of two Chicago police officers involved in the fatal shooting of a black teenager suspected in a carjacking in 2013.

In a written ruling released Thursday, Judge Robert Gettleman cites the video unsealed last week that shows Officer Lou Toth never fired his gun.

Gettlemen says the video shows a different officer, Kevin Fry, shooting Cedrick Chatman. A Chatman family lawsuit against Fry continues.

He notes six seconds passed from the moment Chatman ran from a car to Fry firing. He says Toth didn't have time "either to call for help or to stop Fry."

Gettlemen also criticized the city for opposing, then suddenly backing the release of video footage of the incident.
