Amber Frey's Dad: Peterson Is 'Lying His Head Off'

GRETA VAN SUSTEREN: Last week, we heard testimony about how Scott Peterson met Amber Frey, so when will Amber Frey take the stand? Attorney Gloria Allred joins us from Los Angeles.

Gloria, it would seem like she would be the next logical witness, but I also hear rumblings that she's not yet - that it's not expected this week, maybe next week. Want to give us the heads up? When's your client going to take the witness stand?

GLORIA ALLRED, AMBER FREY'S ATTORNEY: She hasn't been notified, Greta, of when she's going to take the witness stand. It's not going to be this week, to the best of my knowledge.

VAN SUSTEREN: Do you anticipate that the audio tapes will be played before she takes the witness stand, her conversations with Scott Peterson, or during her testimony, or after she leaves the witness stand?

ALLRED: Well, that'll be up to the prosecutor, but I would expect that certain of the tapes would be played, because that's going to really give the jury an idea of the relationship between Scott Peterson and Amber Frey. And I think they'll get an idea about whether this was just about four dates, or whether it was a more significant relationship than that to Scott Peterson.

VAN SUSTEREN: Gloria, if I were the D.A. in this case, and Amber Frey were my key witness, I would spend probably about 25 hours over the last five days of the holiday working with her, discussing her testimony. Is the D.A. paying adequate attention to preparing his witness?

ALLRED: I think that by the time Amber Frey takes the witness stand, she'll be ready to testify. I have confidence in that, and I don't feel comfortable in saying how much time the prosecutor will spend, or has spent, with Amber Frey, but I will say that I believe that she'll be ready when it's time for her to testify.

VAN SUSTEREN: All right. You say will, and then you sort of add has. And so let me probe a little bit deeper. In the last three weeks, has the prosecutor been working with his key witness to prepare her testimony? Are you anticipating that will happen before she testifies?

ALLRED: I think that when she takes the witness stand, she'll be ready to testify. And I don't think it's a matter of hours of preparation being spent by the prosecutor to prepare Amber Frey. The recordings are what they are, and Mr. Geragos will try, as he may, to try to attack Amber Frey, but he's going to have a hard time, because Scott's voice is on those recording, and I think that Scott's going to raise a lot of questions in the minds of those jurors.

VAN SUSTEREN: All right, Gloria. Thank you very much. We look forward to hearing from you again, and hearing from your client on the witness stand. Thank you.

We're going to bring back in our panel. Jim, the reason I asked that question is the prosecutor seems to have had so many problems so far, but I was trying to find out from Gloria if they truly are sort of - if they are working with their witnesses so they don't have these huge problems that they have had so far. For some reason, I don't know why, but ...

HAMMER: I agree.

VAN SUSTEREN: ... that this D.A. is working with his key witness, and he should be.

HAMMER: I agree, and it's come across in some of the examinations, where surprises have come out, which shouldn't happen. Again, everyone makes mistakes. I've made them, you've made them, I know ...

VAN SUSTEREN: I've made them.

HAMMER: I know Bernie's made them, because his mom called and told me about some of them the other day. But I think what they should be doing is having her look at her past testimony and past statements, but also preparing for cross examination. Although Gloria's right, these tapes do speak for themselves, and that's why I think they'll play them first, you can't attack the tapes.

There is word around the hall of justice, around the courthouse, that Amber Frey, she withheld some of the privately made tapes from the police, that something was going on early on where she was not fully cooperative with the police.

I don't know if that's true, but if it is, it gives ample ground for Mark Geragos to really hammer away at why she was cooperating with the supposed killer.

VAN SUSTEREN: Which reemphasizes my point, is that he'd better sit down and talk very openly and plainly with her and ...

HAMMER: A lot.

VAN SUSTEREN: ... get her ready for testimony and find out if she held anything back.

Laura, have you had any information that this D.A. is working with this witness, preparing her for her testimony. I mean, look, she's coming up in the next weeks. She has to, logically. Are you hearing that he really understands he needs to work with her, and he is doing that?

INGLE: Well, certainly that message, as Jim said, has been floating around, and people have been talking about it, but as far as direct contact with Amber Frey, I do not know firsthand of anything like that. But we do know that Detective Buehler probably is going to lay the groundwork to Amber Frey walking into that courtroom, which I can't even imagine what that's going to be like, because when the friend walked in, I mean, everybody was on the edge of their seats.

We know it's going to be a tense moment, so hopefully, yes, the prosecutor will be spending a lot of time with Amber, because she's going to spend a lot of uncomfortable moments with Mark Geragos.

VAN SUSTEREN: Jayne, the big question is, what's Mark Geragos going to do with Amber Frey? Would your recommendation be to question her gently and simply probe information, or do we, as a defense attorney, be aggressive.

JAYNE WEINTRAUB, FORMER SAN FRANCISCO D.A.: I think she needs to be exposed for what she is?

UNIDENTIFIED MALE: Who?

WEINTRAUB: I see her, frankly, as a defense lawyer. I see her as reaching for the brass ring.

VAN SUSTEREN: What do you mean? Wait, then, stop?

Wait a second, wait a second. I've got to stop you there. Expose her for what she is? Exactly what ...

WEINTRAUB: She could file your credit - the pre-taped, the piece that you just showed on the air. I thought that he was unmarried. As Bernie would say, the pious act. I mean, the truth is, she had affairs with other married men, knowingly and ...

VAN SUSTEREN: I'm going to give her the benefit of the doubt. I'm going to wait to hear the cross examination. I'm not going to be ...

WEINTRAUB: It doesn't show he's a murderer.

VAN SUSTEREN: Bernie, aggressively cross examine her or ...

GRIMM: Surgically take her apart piece by piece, I mean, no holds barred. This woman is in the state's camp. She has her own ...

VAN SUSTEREN: How do we know if she's in the state's camp? We don't even know that.

GRIMM: She has her own lawyer who's ... I mean, Gloria might as well stand in front of a used car sale lot, saying, look at this red Cadillac ...

VAN SUSTEREN: But that's we come after her, so in the media, which she needs some defense from us, for God's sake.

GRIMM: Need some defense from us? Gloria hasn't given us an answer for two years.

VAN SUSTEREN: As a result, we haven't gone after Amber, because of the fact Gloria ...

GRIMM: I am with Jayne. High and mighty and she's pious and I didn't know he was married. She slept with him on the first night. I don't care. I've occasionally met women like that, but I didn't take them up on their offer ...

VAN SUSTEREN: I'm going to take us to break. I'm going to wait until I hear her testimony. Anyway, panel, stand by.

GRETA VAN SUSTEREN: More on the Scott Peterson double murder trial.

Laura, expecting that interview, as well as Diane Sawyer and there's a third one, as well, right, that the jury's going to hear at some point?

LAURA INGLE, KFI RADIO REPORTER: That's right. We have heard that they are going to hear a lot of those interviews. And we don't know when those are going to be played. Of course, we always know when something's coming when we see the TVs propped up in the courtroom. Haven't seen that yet. That could come this week.

We know that Detective Buehler may be taking the stand, and he's the one who handled Amber Frey. So we may hear a lot of those audio tapes, a lot of the Amber tapes that were made between Scott Peterson and Amber Frey, when Laci Peterson vanishes.

And we know, from the preliminary hearing - the reporters were allowed to see one of the transcripts of those phone calls, and he is not acting like somebody who is missing his wife. He still hasn't admitted it, at that point, and it's going to be very uncomfortable to hear some of those tapes, because he's calling her sweetie and saying all kinds of sweet things to Amber Frey ...

VAN SUSTEREN: All right, let me interrupt you for - let me interrupt you for one second, Laura. Joining us on the phone is Amber Frey's father, who is calling in - Ron Frey.

Ron, you wanted to call in and add something?

RON FREY, AMBER FREY'S FATHER: Hi, Greta. I'm sitting there watching the tapes of Scott, and it is hilarious. He's sitting there, lying his head off, and I think he probably believes himself. Unreal. That guy is something else.

He's fooling everybody. He's a criminal, and that's all there is to it. But I don't ...

VAN SUSTEREN: Ron, I'm curious, is the prosecution working with your daughter, preparing her for this very important testimony?

FREY: Oh, I think you'd have to ask Mrs. Allred. I don't speak out for Amber or Ms. Allred.

VAN SUSTEREN: But how about for the D.A.'s office? I mean, are you in contact at all with the D.A.'s office?

FREY: No, but I hope Jim Brazelton is in the courtroom. I think the fact of his appearance would greatly help this case. I still believe he's the man to put in the courtroom, whether he's had these other problems or not. At least he speaks his mind, and he's not afraid to come forward.

So I think what Jim Brazelton and the court - Mr. Geragos - won't know quite what to do with themselves.

VAN SUSTEREN: What do you think so far, Ron, about the way the case has progressed?

FREY: Oh, Distaso's come out punching pretty good this last week. Brocchini, I'd mentioned with Ms. Cosby. We don't need this testimony. It's almost better if he hadn't come forward.

But it will be real interesting, this next week and the week after. But Scott, watch your own show. It's hilarious. Watch, Scott - best comedy I've ever seen, but the tragedy is, there is still a dead body, and I think he knows how it happened. Ask him, he did it. He did it.

VAN SUSTEREN: And, of course, there's actually two dead bodies. Of course, we can never forget poor Conner.

Ron, I appreciate you very much for calling in this evening. Obviously, I know these are rough times for you and your family.

Bernie, you've got five seconds ...

GRIMM: The problem is, Scott, sympathetic in one tape, crying on cue in another tape, other tapes, just - they're going to hurt.
