Casey Anthony's defense team is trying to get some potential evidence thrown out in in State's capital murder case against their client, MyFoxOrlando.com reported.
Remember the frantic 911 call made by Casey's mom Cindy back in July 2008? "There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car," Cindy Anthony told a 911 dispatch operator. Casey's lawyers are asking the judge to throw it out so, so a jury could never hear it. The defense's argument, that there was not an emergency at the time the call was made. The defense argues that 2-year-old Caylee had already been missing for 31 days. Therefore, they argue the call is neither spontaneous or reliable.
That's not all the defense doesn't want a jury to see. Remember the photos of Casey partying? The defense says only the pictures captured of Casey wearing a blue dress were snapped during the time that Caylee was missing. According to the photographer, pictures of Casey partying in that blue dress were taken June 20-21 at Fusion night club. That was less than a week after Caylee was last seen alive.
"These pictures do not bear a single issue in this case," according to Casey's defense team. "Their only value is to paint a picture of an irresponsible, drunken, promiscuous and wild defendant." The defense states that those pictures contain "inflammatory imagery that would unfairly prejudice Miss Anthony before a jury."
The defense also asks the judge to throw out all "hearsay" statements between Casey's friends and family. The defense categories those into hearsay that would categorize Casey Anthony as a thief, a liar or a bad mother.
The defense has asked that the state respond to these motions within one month.
More documents are expected this week in the case against Casey Anthony. As the case progresses her attorney fees are starting to add up. Her lawyers want taxpayers to help foot the bill.
Anthony’s defense team filed a motion to get the state to help pay the cost of her trial. They say money is needed for travel, serving subpoenas, hiring experts and more.
A judge will have the final say if taxpayer money will be used to cover part of her bill.
Casey Anthony remains jailed on a charge of first-degree murder in the death of her daughter Caylee who was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's home on December 11, 2008. Investigators say the toddler's body was found with duct tape over her mouth.
Casey has pleaded not guilty and claims a babysitter kidnapped Caylee.
