An Indiana state representative reportedly resigned Tuesday after a sexually-explicit video was sent from his cellphone.

Republican Jud McMillin, majority floor leader of the Indiana House of Representatives, says the video was sent while the phone was not in his possession but that he is nevertheless resigning to spend more time with his family.

“My phone was stolen in Canada and out of my control for about 24 hours,” he said in a text message. “I have just been able to reactivate it under my control. Please disregard any messages you received recently. I am truly sorry for anything offensive you may have received."

McMillin’s Facebook page shows his relationship status as married.

He also sent a second text to contacts apologizing for “anything offensive,” according to The Indianapolis Star newspaper.

“Our caucus is thankful for Representative McMillin’s service to our state, and we fully support his decision to step down in order to focus on his family,” House Speaker Brian Bosma said in a statement Tuesday afternoon, according to The Star.

The 38-year-old McMillin was elected to the state legislature in 2010 and represents a district in southeastern Indiana.
