A 16-year-old boy accused of trying to steal Nike sneakers from an Ohio mall shopper who fatally shot another teenager who was with him has been indicted on involuntary manslaughter.

The boy is being prosecuted as an adult in Montgomery County. He's also charged with robbery.

Attorney L. Patrick Mulligan says the boy will plead not guilty at arraignment April 16. Mulligan says they're pleased the case was moved to common pleas court to be heard by jurors, not just a judge.

Police say the boys accosted shoppers who had bought limited-edition Air Jordan sneakers at the Dayton Mall days before Christmas. One boy showed a gun and was shot by a shopper with a concealed-weapon permit.

Under Ohio law, a suspect can be held responsible for an accomplice's death during a robbery.
