The district attorney in Las Vegas says prosecutors won't seek the death penalty against two men charged with killing a mother of four in what was initially described as road rage.
Clark County District Attorney Steve Wolfson said Wednesday he and a panel of supervisory deputies decided capital punishment isn't warranted in the case against 19-year-old Erich Milton Nowsch Jr. and 26-year-old Derrick Andrews.
Nowsch is accused of killing 44-year-old Tammy Meyers in February in a spray of gunfire from a silver Audi sedan with Andrews at the wheel.
It eventually became evident that the shooting stemmed from a tragic series of coincidences and misperceptions.
Nowsch and Andrews have pleaded not guilty to murder, attempted murder, weapon and conspiracy charges. Trial is scheduled May 26.
Nowsch's and Andrews' lawyers call the DA's decision appropriate.
