Jailed real estate heir Robert Durst's attorneys say they followed all the rules when they subpoenaed the FBI agent and state trooper who arrested Durst in March, so their call for state court testimony should stand.
Federal prosecutors have asked the U.S. District Court in New Orleans to throw out the subpoenas and the possibility that a state magistrate might hold the three in contempt for failing to show up for a March hearing.
The federal judge considering that question put off a hearing scheduled Tuesday until April 27.
Durst, an estranged heir of the family that owns 1 World Trade Center, has waived extradition to California, where he faces a murder charge.
State and federal weapons charges filed in Louisiana have kept him jailed there.
