Conviction against ex-Goldman Sachs programmer overturned; was tried twice over code theft

A New York court has again overturned the conviction of a former Goldman Sachs programmer twice tried for stealing confidential computer code.

Sergey Aleynikov (SUR'-gay uh-LAY'-nih-kawf) told the New York Times (http://nyti.ms/1UtlxNQ ) Monday that state Supreme Court Justice Daniel Conviser's ruling feels great.

A Manhattan jury found the 45-year-old guilty of illegally using secret material in May. His lawyers have maintained Aleynikov violated Goldman confidentiality rules, not the law, and the case is a civil matter.

Aleynikov was first arrested in 2009 on federal charges and found guilty three years later. He served a year in prison before an appellate court overturned that conviction.

Six months later, Manhattan District Attorney Cyrus R. Vance Jr. unsealed state charges against him. A spokeswoman for Vance says prosecutors are considering whether to appeal.
