Attorneys trying to stop the execution of a condemned Ohio killer say the state's untried capital punishment method will cause him agony and terror.
The defense lawyers allege the two-drug combination won't properly sedate the death row inmate, Dennis McGuire, and he will experience a suffocation-like syndrome known as air hunger.
The lawyers asked in federal court filings Monday and Tuesday that McGuire's execution be delayed while they challenge the proposed lethal injection.
The 53-year-old McGuire is scheduled to die Jan. 16 for the 1989 rape and fatal stabbing of Joy Stewart in Preble County in western Ohio.
A message was left with the Ohio attorney general's office, which is expected to oppose McGuire's request.
Gov. John Kasich has yet to rule on McGuire's separate request for mercy.
