Supreme Court nominee John Roberts (search) said Wednesday that Congress has the right to counter a controversial Supreme Court ruling and decide whether cities have the right to seize private property for commercial or public use. Jim Angle has details on today's hearing.

Then, a federal judge in San Francisco declares the pledge of allegiance in public schools unconstitutional, acting on a case similar to the one the Supreme Court dismissed on procedural groounds. Megyn Kendall has the details.
