The New York state health commissioner has used his emergency powers to immediately suspend the license of an Upper East Side plastic surgeon accused of medical misconduct, incompetence and “moral unfitness.”

Dr. Brad Justin Jacobs, 45, who works out of an office on 55 E. 86th St. in New York City, is charged with 19 incidents of medical misconduct involving 10 patients, according to a news release issued by the state health department Tuesday.

According to the release, Jacobs is accused of gross negligence, negligence on more than one occasion, incompetence on more than one occasion, moral unfitness, and failure to maintain records in performing breast augmentations, liposuction and rhinoplasty.

The health department charged that Jacobs failed to perform adequate physical exams or take adequate histories of some patients, and failed to appropriately follow up when patients experienced complications, such as infections.

He is also accused of using breast implants that were too large for the breast pocket, and engaging in sexual intercourse and drug use with a patient.

Jacobs’ lawyer, Michael Kelton, said the allegations are unfounded, according to an article in the New York Sun. A hearing on the charges has been scheduled for June 28.

The suspension means that Jacobs cannot, for now, practice medicine. His Web site, www.drjacobs.com, was down Wednesday afternoon.
