California Parks Department Appeals Ruling on Nude Sunbathing

Beachgoers in San Diego County may still have to fight for their right to be naked.

In the latest in a series of legal volleys, state parks officials filed a notice of appeal Wednesday to overturn a judge's ruling from last week that nude sunbathers on San Onofre State Beach can only be cited if a private citizen complains.

The ruling from Orange County Superior Court Judge Sheila Fell reinforced the same policy that has been in place since 1979, but complaints of lewd behavior had brought a crackdown by state parks officials earlier this year.

They announced they would outlaw nudity as of Sept. 2.

Spokesman Roy Stearns says parks department officials "respectfully disagree with the judge's ruling."
