DOJ punches back after Illinois city moves to dismiss lawsuit against 'race-based' reparations program

FIRST ON FOX: The Department of Justice (DOJ) is pushing back after the city of Evanston, Illinois, signaled plans to throw out a federal lawsuit challenging its race-based reparations program.

The legal standoff escalated after a federal judge granted the Justice Department’s request to intervene and join the civil rights lawsuit originally brought by conservative watchdog group Judicial Watch.

Attorney Precious S. Jacobs-Perry, who represents Evanston, indicated the Chicago suburb intends to file a motion to dismiss the government's complaint, while insisting the city will not back down on its program.

"Evanston’s race-based 'reparations' program is illegal under federal law. We will be opposing the motion to dismiss," a DOJ spokesperson told Fox News Digital on Monday.

Democratic Evanston Mayor Daniel Biss has fired back against critics of the program, telling CNN in June it was done to attack a wealth gap and "pay a debt."

The initiative provides $25,000, direct, housing-related benefits and cash payments to Black residents and descendants of Black residents who lived in Evanston between 1919 and 1969. In 2019, Evanston became the first U.S. city to approve a municipal reparations plan, pledging $10 million over a decade funded by a local cannabis tax.

However, the DOJ contends the suburb’s program unlawfully distributes taxpayer benefits based strictly on race and ancestry. In its complaint, federal prosecutors allege the program violates the Equal Protection Clause of the 14th Amendment as well as the Fair Housing Act.

The Justice Department’s aggressive stance comes after U.S. District Judge John F. Kness previously denied Evanston’s attempt to toss out Judicial Watch's underlying lawsuit.

Judicial Watch filed the class-action civil rights lawsuit on behalf of six non-Black individuals who lived in or had ancestral ties to Evanston during the qualifying era but were barred from applying due to their race.

"Evanston’s $25,000 government payments based on race are blatantly unconstitutional," Judicial Watch attorney Michael Bekesha told Fox News Digital. "Evanston already tried and failed to dismiss Judicial Watch’s lawsuit, and we do not expect its latest effort to dismiss the Justice Department’s complaint to succeed."

Bekesha, senior attorney for Judicial Watch’s Constitutional Rights Litigation Program, added: "Regardless of what happens with the Justice Department’s case, Judicial Watch will continue fighting to end Evanston’s racist reparations program once and for all."

Evanston spokesperson Cynthia Vargas said, "The City of Evanston does not comment on pending litigation, but we will continue to vehemently defend any lawsuit brought against our City's reparations program."

No. 1 Florida Gators face No. 14 Miami Hurricanes in top matchup as college basketball tips off

I wouldn't blame you at all if you were unaware that the Men's College Basketball Season started today. It does, and there are a ridiculous number of games on the slate tonight. Most of the games are not impressive — a team like Texas taking on Chicago State is not an interesting game. They are going to win by 30 or more, and the spread is 41.5. Spreads and betting do help make the game more exciting, but I have a different game that should be more entertaining anyway. Miami and Florida battle tonight in the only ranked match up of the day.

The Miami Hurricanes come in ranked as the 14th-best team in the country. As with many teams in the college ranks, the Hurricanes are trying to quickly integrate returning stars with transfers and additions. The key returning players are Malik Reneau, Shelton Henderson, and Dante Allen. Reneau was the team's leading scorer last year and should once again be the focal point of the offense. Henderson is entering his second year and will likely give the team some solid outside shooting. Allen isn't quite the scorer the other two are, but he does make solid plays and could be an excellent facilitator and occasional scorer.

In terms of transfer players, the team will have point guard Acaden Lewis coming over from Villanova. It wasn't like Villanova was great last season, but it is a high-quality program, and Lewis could be a difference-maker for Miami. Somto Cyril is a rim protector, and he should be a good dump-off option. I am concerned to see how Reneau and Cyril space down low. Both can clog the paint, but that might mean they get better looks from the outside.

The Florida Gators are currently the top-ranked team in the nation. At least part of this is due to their returning starters. It also isn't much of a surprise that this team would have success after winning a National Championship a few years ago. Boogie Fland is back for another season and coming off a year where he shot almost 45% from the field. Alex Condon returns as well and provides a great post presence and does all of the dirty work for the Gators.

The team also slides Urban Klavzar into the starting lineup. Last season, he was the SEC Sixth Man of the Year, and Klavzar is a great outside shooter. Their bench even has some guys providing excellent backup options. That doesn't mention their best player, Thomas Haugh. He chose to stay for another year at Florida instead of taking on the NBA. I'm not sure he would've been a high draft pick, though. The team is deep and has played together for a long time.

Longevity and familiarity should help the Gators in this game. Florida is expected to be one of the best teams in the country, and they come into this knowing the goals, game plan, and plays. Tonight's contest is at a neutral site, being played in Tampa. Seeing as it is the first game of the season and played in an unfamiliar arena, the under is a very logical choice. I think a better option is to take Florida -5.5, though. They should have the edge in this game behind a deep team, and one that has played together for a couple of years at least. Give me the Gators to cover.

Video shows George Pickens wasting no time leaving the field after Cowboys brutal loss to Cardinals

Dallas Cowboys wide receiver George Pickens could not get off the field fast enough after his team blew a 14-point lead in the fourth quarter to lose to the Arizona Cardinals on Sunday.

The Cowboys grabbed hold of a 24-10 lead on the second play of the fourth quarter before being outscored 20-6 over the remaining 14 minutes and change inside Jerry's World. The Cardinals officially pulled off the stunning comeback with a 42-yard field goal with just under three minutes remaining in overtime to steal a 33-30 win.

With the loss, Dallas fell to 3-5 on the year, with three of its five losses coming at home, and Pickens made it abundantly clear that he has had enough of the losing.

In a video that has made the rounds on social media, Pickens was seen quickly running to the Cowboys' locker room just after the Cardinals ended the game. Even when you consider that there is likely a slight delay between play on the field and what is shown on the screens inside the stadium, Pickens got off the field in a hurry.

While Pickens was undoubtedly upset about losing, he couldn't have been too happy about his final stat line from the contest either.

Pickens hauled in just two catches for 48 yards against Arizona, and his four total targets were the second fewest he's gotten all season. For comparison, CeeDee Lamb was targeted 11 times by quarterback Dak Prescott during the contest.

The sky may seem like it's falling in Dallas, which is a feeling Cowboys fans are used to at this point, but with the franchise being a part of the NFC East, all hope is, miraculously, not lost just yet.

While Dallas would much rather be 4-4 on the year as opposed to 3-5, the Cowboys are still very much alive to win the division. The New York Giants lead the way at the moment with an overall record of 4-2-1.

Bears vs. Seahawks tonight as Caleb Williams faces one of the best defenses in football

This was one of the strangest weeks of football I can remember. That doesn't mean there were no upsets or that there were otherworldly performances from players. It was just a strange day of football, with a team winning without completing a pass and another team losing two quarterbacks on a total of four drives. Will the weirdness continue tonight, or will the Bears and Seahawks have a fun and exciting game tonight?

The Chicago Bears are one of the more exciting teams in football. They are 5-2 for the season with a 2-1 road record, and they now have their quarterback under center again, giving them a dynamic and exciting offense. However, this will likely be the hardest game of their early season. They are facing one of the best defenses in football, and it may be a struggle for the Bears to get that offense rolling. Caleb Williams will need to use his legs and arm to give the Seahawks different looks.

I will say that I wonder just how good the Bears actually are this season. Their wins were against the Panthers, Eagles, Jets, Falcons, and Patriots. Their losses were against the Vikings and the Packers. The Panthers could be a playoff team, and the Patriots should make it to the postseason, but the only ones that have a greater than 50% expectation of making the playoffs are the Vikings, Packers, and Patriots. The team just went out and traded for Jeffery Simmons to bolster the defense, and perhaps that will make the difference.

The Seattle Seahawks are the defending champions, but their team has struggled a bit this season. Sure, they've shown flashes of excellence. Some of their games have been very impressive, and the team is 4-3 for the year, but there are also some questionable games. They've lost to the Commanders, 49ers, and Broncos. Two of those three are almost certainly destined for the postseason. The wins have been over a bad Chargers team, the Patriots, the Cardinals, and last week, the Chiefs.

What exactly is the issue, then? The defense is elite, the team has a decent schedule, and the offense is ranked 12th in the NFL in yards per game. Honestly, it is hard to pinpoint. Sam Darnold hasn't been very good this season, and the running game has struggled. The team is averaging just 113.7 yards per game on the ground, which is about middle of the pack. Darnold, though, has thrown eight touchdowns and also eight interceptions. Jaxon Smith-Njigba might be the best receiver on the planet, and if he were off the team, it probably wouldn't have a passing game either.

I think this game is likely to go under the 46.5 total. The Bears are a good enough offensive team, but I don't think we can count on them to be quite as effective tonight. The Seattle defense and the home crowd should be very active tonight. The Bears' defense is not great, but they play a style that should be perfect for this game. They bend but don't break. The Seahawks' offense is just not great at getting into the end zone right now. Smith-Njigba should have a good game against an inferior secondary, but it all depends on whether the Seahawks offensive line can give Darnold enough time and Darnold makes the right reads. Give me under 46.5. I do lean to Seattle covering as well.

Union boss stuns with major Republican endorsement as election nears

The leader of one of the nation’s oldest and largest unions stunned political observers by issuing a surprise endorsement for a Senate Republican stalwart over the weekend.

Teamsters General President Sean O’Brien, who famously nearly came to blows with now-Secretary of Homeland Security Markwayne Mullin during a Senate hearing before ultimately becoming acquaintances, issued a ringing endorsement of Sen. Ashley Moody, R-Fla., signaling a major break from national union sentiment that has tended to favor Democrats.

"Just voted in the State of Florida for the first time, and very proud to have cast a ballot for Sen. Ashley Moody," O’Brien, whose 123-year-old union is about 1.3 million-strong, announced Sunday.

Fox News Digital reached out to the Teamsters as well as Moody’s campaign for comment.

Moody, a former state attorney general, said in a statement that she was proud to have O’Brien’s endorsement:

"I’ll always fight to protect hardworking Americans, strengthen good-paying jobs, and ensure resources are available to train our next generation. It’s been great to deliver for Florida’s working families," she said.

After O’Brien endorsed Moody, the lawmaker’s Democratic opponent responded by posting a photo she once took with O’Brien and writing that "Ashley Moody never walked the line with you."

O’Brien also caught heat for voting in Florida, which appeared to signal a move from his hometown of Boston.

DOJ appeals to Supreme Court to reverse block on segregating 20K California ballots

The Justice Department asked the Supreme Court to temporarily block lower-court rulings that denied its request to segregate more than 20,000 California mail-in ballots cast by people it says are likely not U.S. citizens.

The DOJ argues the limited injunction would preserve the ballots while their eligibility is investigated, without canceling any votes. California and the federal government dispute whether the ballots are unlawful.

"Once illegally cast ballots are counted and commingled with lawful votes, the resulting harm is impossible to remedy," the Justice Department wrote in a court filing.

JUDGE REJECTS DOJ REQUEST TO BLOCK CALIFORNIA FROM IMMEDIATELY COUNTING BALLOTS LINKED TO ALLEGED NONCITIZENS

The 9th U.S. Circuit Court of Appeals rejected the request Friday, with Judge Patrick Bumatay dissenting, as did a federal judge in Los Angeles last week. The case remains under review, and the DOJ is seeking relief while the matter proceeds. California says its safeguards against noncitizen voting are robust and argues the federal list may contain errors that could disenfranchise eligible voters. The lower courts also cited the state’s authority over election procedures and warned that granting the request could jeopardize the election.

DOJ HAS VERIFIED 20,000 NONCITIZENS ON CALIFORNIA VOTER ROLLS, FEDERAL PROSECUTOR SAYS

The case stems from an Oct. 15 Justice Department lawsuit alleging that California is impeding enforcement of a federal law barring noncitizens from voting in federal elections. The administration says the state violated the Constitution’s Supremacy Clause, which generally gives federal law precedence over state law.

The dispute comes amid the administration’s broader push to influence how states run elections, including demands for access to voter rolls and warnings that officials could face prosecution for knowingly allowing noncitizens to vote.

James Talarico, a U.S. Senate candidate in Texas, briefly praised Frederick Haynes III, a Democratic congressional candidate who compared President Donald Trump's immigration enforcement efforts to the KKK, at a get-out-the-vote event on Thursday as part of his Clear Eyes Full Hearts tour.

"Give it up for your next congressman, Dr. Freddy Haynes. Thank you, Dr. Haynes, for those kind words and for your service to this community," Talarico said, following an introduction and speech from Haynes.

Although Talarico has not issued a formal endorsement of Haynes, the moment is notable for Talarico as he pitches himself as a Democrat who can represent the values of the Republican-leaning Lone Star State — and as he tries to distance himself from controversy over past remarks Republicans have characterized as woke.

TALARICO RALLY WARMUP ACT CALLS FOR ABOLISHING ICE, CONTRASTING SENATE HOPEFUL'S MESSAGE

Haynes, the pastor of Friendship-West Baptist Church, has framed many of his political views in the context of race and did so again on the event with Talarico.

"You transformed ICE into the new KKK and brought about terror in this nation," Haynes said of Trump's use of Immigration and Customs Enforcement (ICE).

"It’s time to melt ICE. It’s time to abolish ICE," Haynes added.

Haynes is running to fill the seat of Rep. Jasmine Crockett, D-Texas, the incumbent in Texas' 30th Congressional District who gave up her seat in a Senate bid she ultimately lost. During his campaign, Haynes has framed his support for climate policy as a fight against "environmental racism." He has also accused conservatives and the Trump administration of benefiting from fears of Black advancement.

"They have used Black people and perceived Black progress as the boogeyman. We have not witnessed this kind of corruption, this kind of blatant corruption," Haynes said in an October interview.

"We are witnessing the demolishing of what democratic infrastructure was built by the gains of the civil rights movement," Haynes added.

Even before his congressional run, Haynes made political commentary that relied heavily on a racial lens.

After the death of Charlie Kirk, a conservative political commentator who started Turning Point USA, Haynes described Kirk as a man with views "rooted in White supremacy" and contrasted it with the deaths of Martin Luther King Jr. and Malcolm X.

"A White Christian gets killed, murdered — not assassinated. We going to tell the whole truth today. Martin King got assassinated. Malcolm X got assassinated. Medgar Evers got assassinated. Don’t compare Kirk to King," Haynes said in a September 2025 address to his church.

UN PUSHES NATIONS TO CONSIDER SLAVERY REPARATIONS BUT LEGAL GROUP SAYS IDEA 'NOT GOING TO FLY IN THE US'

Haynes would go on to condemn Kirk's death and political violence.

Haynes has also said he was a personal supporter of reparations.

"America, you owe us. What you done to us has been immoral. It’s been evil. It’s been unjust. It’s been downright wrong and the only way to bring salvation to America — you gotta pay us what you owe us," Haynes said at a Solidarity for Reparations event at a San Francisco church.

"I've come by to say, San Francisco, California, Texas, United States of America, if you want salvation to come to this house, you've got to engage in reparations."

For his own part, Talarico has also supported the idea of reparations, framing it as an outflow of his religious convictions.

"Reparations, repairing past harms, is part of my faith tradition. It’s part of the values I was raised with," Talarico said in a town hall meeting in July. "We have to correct the injustices of our past."

In the closing days of his campaign, Talarico has argued that, despite some of his views on race and gender which run counter to conservative stances, he could still represent Texas as a moderate.

"Our campaign has been able to show that you can be a more moderate, reasonable candidate and still be exciting," Talarico said in October.

Copilot killed in fiery Florida Learjet crash identified as 20-year-old who learned to fly before driving

The copilot aboard a private jet that crashed into a South Florida neighborhood Sunday, killing all nine people on board, has been identified as a 20-year-old aspiring airline pilot who earned her wings before getting her driver's license, according to a report.

Nathalia Gadelha Filgueiras' mother and stepfather confirmed to the New York Post that she was the copilot aboard the Learjet 60 that plummeted into a residential area in Palm Beach County while traveling from Texas to the Bahamas.

Filgueiras, who grew up in Palm Beach County, made headlines in 2023 when she earned her private pilot's license at just 17 years old while attending West Boca Raton High School.

"I definitely do brag because people say, 'Oh, you can't drive,' and I'm like, 'Yeah, but I can fly,'" she told local station CBS12 at the time.

Filgueiras began taking flying lessons in 2020 and received additional instruction from her father, who had learned to fly recreationally in 2018, the outlet reported at the time.

The 2023 news report detailed how she accumulated 88 hours of flight time while pursuing her private pilot's license, which was funded through the School District of Palm Beach County's Aviation Academy.

The young aviator later graduated from American Flyers, a flight school based in Addison, Texas, with a location in Pompano Beach, Florida, according to the Post.

Filgueiras told CBS12 that she hoped to become a commercial airline pilot.

In a recent social media post cited by the Post, she shared a video of herself flying with her boyfriend, Justin, highlighting their aviation accomplishments at such young ages.

"How often do you see 2 pilots under 21 with a commercial, multi-engine, instrument, CFI/CFI-I," she wrote, referring to several aviation certifications and instructor ratings.

The Learjet 60 departed Austin-Bergstrom International Airport in Texas and was headed to North Eleuthera Airport in the Bahamas when it crashed near Cresthaven, Florida, around 12:50 p.m. Sunday, according to the Federal Aviation Administration.

All nine people aboard the aircraft were killed, Transportation Secretary Sean Duffy confirmed Sunday afternoon.

Air traffic control recordings captured by LiveATC.net revealed that the flight crew reported ice accumulation and turbulence before the aircraft began rapidly losing altitude, according to The Associated Press.

"We have light, clear ice that is manageable and moderate turbulence," a pilot told controllers.

The crew subsequently requested permission to climb another 2,000 feet before declaring an emergency as the aircraft plunged toward the ground.

"We're descending 8,000 — mayday, mayday — we're descending 10,000 feet per minute," a pilot radioed, according to the AP.

"We are in an overspeed condition descending 20,000 feet per minute," the pilot continued, before warning, "We're going to crash into the ground."

Dashcam footage captured the jet plunging nose-first into the neighborhood, as Fox News Digital previously reported.

Florida Gov. Ron DeSantis described the crash as "cataclysmic."

The crash also forced the evacuation of approximately 600 people from a nearby mobile home community, according to local officials.

The FAA and National Transportation Safety Board are investigating the crash. The cause has not been determined, and NTSB officials are expected to provide an update Monday.

Mamdani, Hasan Piker among radical left-wing voices erupting over Haley Stevens' endorsement switch

Prominent Democrats and left-wing voices nationwide exploded with fury after Rep. Haley Stevens, D-Mich., endorsed Republican Mike Rogers in the final stretch of Michigan's U.S. Senate race over the weekend.

In her video posted to social media on Sunday after attending church service with Rogers, Stevens noted how Democratic candidate Abdul El-Sayed told her to "stay away" from his campaign and slammed him for embracing radical steamer Hasan Piker — who was among those criticizing the endorsement.

"Working class people’s lives are on the ballot on Tuesday—their healthcare, their rent, their bills," New York City Mayor Zohran Mamdani said in an X post. "Haley Stevens just betrayed them by endorsing the very Republican she said she wanted to run against."

Michigan Democratic Party Chair Curtis Hertel said on X shortly after the endorsement: "Congresswoman Stevens is not a current member of the Michigan Democratic Party, nor will she be in the future."

EL SAYED'S LEFT-WING ALLIES ATTACK 'EVIL' STEVENS AFTER BOMBSHELL ROGERS ENDORSEMENT

Stevens, who will leave Congress in January, lost the Democratic primary to El-Sayed earlier this year. She was widely viewed as the moderate, establishment candidate compared to the more progressive, left-wing policies of her opponent.

On Sunday, Stevens abandoned the party in the final hours of the Senate campaign as Democrats seek to win back control of the upper chamber.

"This is a despicable betrayal from Rep. Stevens," Senate Minority Leader Chuck Schumer, D-N.Y., said on X. "Senate Democrats are united in our support for Abdul El-Sayed, because we know he will fight for the economic interests of working families in Michigan, unlike Mike Rogers, who is a tool of Donald Trump and billionaire donors."

"Haley Stevens made a terrible decision, blindsided everyone and isolated herself from the House Democratic caucus," said House Minority Leader Hakeem Jeffries, D-N.Y. "We will have a discussion about appropriate next steps upon our return."

Rep. Mark Pocan, D-Wis., called Stevens "clearly disturbed," and said she "has thrown her constituents under the bus" on several key midterm issues.

Outside of her own colleagues condemning her endorsement, Stevens also saw an immediate staff exodus after she posted the video.

After the endorsement, a visibly upset El-Sayed demanded the media focus their questions on political issues, rather than Stevens' endorsement.

FORMER RIVAL DODGES FULL-THROATED EL-SAYED ENDORSEMENT AFTER BITTER SENATE PRIMARY

Stevens drew an official condemnation from the Democratic Party at a national level, too.

"Haley Stevens’ disappointing decision to endorse Mike Rogers, a Trump ally who would join Republican efforts to sell out working families, is a betrayal of the values of the Democratic Party," Democratic National Committee (DNC) chairman Ken Martin said in a statement on behalf of the organization.

"At a moment when Democrats are united in fighting for Michigan families and standing up to Trump’s agenda, we reject these efforts to sow division within our party. We will not allow last-minute political stunts to derail our momentum and we will triple down on our efforts to elect Abdul El-Sayed on Tuesday."

The Democratic Senatorial Campaign Committee (DSCC), chaired by Sen. Kirsten Gillibrand, D-N.Y., lashed out at Stevens' decision, too.

Piker, who was partly the reason for Stevens' break from El-Sayed, simply wrote: "i [sic] condemn haley stevens."

Piker has caused major controversy in the Michigan race due to his proximity to El-Sayed. Since his primary win, the progressive candidate has sought to distance himself from the streamer.

"This is the single most unproductive, selfish thing a Democratic candidate has done all cycle and likely many cycles before that," Jon Favreau, Pod Save America cohost and speechwriter to President Barack Obama, said on X. "Having misjudged candidates in the past myself, I hope everyone who tried to recruit, support, and defend Haley can now admit what a mistake it was."

Fellow PodSaveAmerica cohost Jon Lovett called Stevens a "sleaze."

"Not to downplay Haley Stevens' vermin-like betrayal of her party and her constituents and her nation... But given her track record as a clownish loser, do we really believe any who will now follow her weren't already going to vote for the Fascist?" podcaster and former television sports personality Keith Olbermann said in an X post.

Stevens, who was narrowly defeated by El-Sayed in Michigan's Aug. 4, 2026 primary election, crossed partisan lines after saying for months that she would support El-Sayed.

It all devolved after Stevens expressed concern last week over an ad aired in El-Sayed's favor that was widely viewed as antisemitic. She said she would appear at a weekend campaign event with El-Sayed on the condition that he denounced the ad. El-Sayed, whose support among the Michigan Jewish community is already tenuous, disinvited her from the event instead.

The ad that sparked the controversy was released by the Rebellion PAC, which is operated by The Young Turks co-founder and bombastic leftist commentator Cenk Uygur, who is Piker's uncle. Piker, whom El-Sayed invited onto the campaign trail in Michigan during primary season, has been a headache for El-Sayed during the general election.

Piker said in 2019 that "America deserved 9/11." He has also praised Mao Zedong and Communist China, said capitalists should be murdered in the streets, and is known for making antisemitic comments.

Judge tosses case against ex-FBI officials accused of lying to Congress about Hunter Biden investigation

A federal judge tossed criminal charges against two former FBI officials accused of lying to Congress about the Hunter Biden investigation Monday, delivering a blistering rebuke of the prosecution and accusing the Trump administration's Justice Department of weaponizing the justice system.

U.S. Magistrate Judge Zia Faruqui dismissed the criminal complaint against former FBI officials Nikki Cole Floris and Bradley Benavides from the bench, sharply criticizing the government's handling of the prosecution.

"What has transpired here cannot be described as anything other than weaponization," Faruqui said, describing the case as a "rush job" directed by President Donald Trump and FBI Director Kash Patel.

The case stemmed from allegations that the officials lied to Congress about their knowledge of Hunter Biden’s laptop and the bureau’s handling of investigations involving him ahead of the 2020 presidential election.

EX-FBI OFFICIALS ARRESTED IN HUNTER BIDEN LAPTOP PROBE AS TESTIMONY COMES UNDER SCRUTINY

The ruling capped a series of hearings in which Faruqui questioned the government's decision to pursue the case through a criminal complaint rather than a grand jury indictment and blasted prosecutors for attempting to add another charge without first securing judicial approval.

Republicans have long accused the FBI of improperly handling information about Hunter Biden ahead of the 2020 presidential election, alleging that political bias influenced the bureau's decisions.

Prosecutors alleged that Floris and Benavides made false statements during congressional interviews in 2023 about what they knew and did that were contradicted by internal FBI communications and witness accounts.

During a preliminary hearing last week, Faruqui blasted prosecutors for filing an unsigned, unsworn criminal complaint seeking to add obstruction charges without first obtaining judicial approval.

Faruqui struck the revised complaint from the record, forcing prosecutors to proceed on their original allegations that the former officials lied to Congress.

The judge questioned why prosecutors had bypassed standard procedures, while defense attorneys pointed out that the revised complaint also softened the government's original allegations about the officials' involvement in Hunter Biden investigations.

Faruqui, who was appointed a U.S. magistrate judge in 2020, has previously sharply criticized federal prosecutors handling cases under the Trump administration.

He apologized to the suspect accused of plotting an assassination attempt against Trump at the White House Correspondents’ Association Dinner.

"To me, it’s extremely disturbing that he was put in five-point restraints, a person with no criminal history. It’s troubling," said Faruqui, referring to suspect Cole Allen's jail treatment in May. "I never heard of one Jan. 6 defendant who was put in five-point restraints or in a safe cell. If the only way to keep him safe is the most punitive thing, that’s a problem."

Faruqui also previously clashed with federal prosecutors in Washington over Trump administration law-enforcement surge cases, accusing U.S. Attorney Jeanine Pirro’s office of overreaching by bringing some matters in federal court that he said belonged in local court.

Christa Pike's execution doctor says misplaced IV sent lethal drugs into her arms instead of veins

The doctor who participated in Christa Pike's failed execution in Tennessee says an improperly placed IV sent lethal drugs into the tissue of her arms instead of her bloodstream — and acknowledged the execution team should have stopped when the death row inmate complained of pain.

Dr. Mark Fowler, who served as the physician during Pike's Sept. 30 execution attempt, offered a rare firsthand account of what went wrong in an interview with New York Magazine published Friday.

Pike, 50, survived after receiving two doses of pentobarbital and was hospitalized for days before eventually regaining consciousness.

The doctor told the magazine he knew something was wrong when Pike's execution stretched to about 45 minutes. When he was called into the chamber, she was still alive and gasping for air.

Fowler said he initially considered whether Pike's response to the medication could simply be taking longer than expected and decided to give it more time.

As another half-hour passed, he became concerned that Pike could survive with irreversible brain damage. Fowler later diagnosed her as comatose before a deputy commissioner ordered the execution stopped.

He then ordered oxygen, and Pike was taken by ambulance to Vanderbilt University Medical Center.

Fowler told New York Magazine that the IV used to administer the pentobarbital had not been properly inserted into Pike's veins.

"It was delivering medicine to the subcutaneous tissue" of her arms, Fowler said.

Pike's attorneys previously said in a court filing that she complained of severe arm pain during the execution, telling those in the chamber, "My arm feels like it’s about to burst open."

"They should have stopped and reassessed, and they didn’t," Fowler told New York Magazine.

The account comes days after Pike described the aftermath of the failed execution in a statement released by her attorneys, saying she remains in constant pain and still struggles to speak.

"My body hurts. My arms hurt. My hands hurt. My throat hurts," Pike said Friday. "I still struggle to speak."

Pike also said she was "deeply hurt by the incompetence that has put so many people in this terrible position."

Fowler's role in Pike's failed execution was not his first to draw scrutiny.

New York Magazine reported that Fowler was also involved in the 2025 execution of Byron Black and the failed May execution of Tony Carruthers.

In the Carruthers case, Fowler attempted to place an IV near Carruthers' clavicle after paramedics were unable to establish traditional IV access. Fowler told the magazine he ultimately stopped because he lacked adequate anesthetic and the procedure was becoming too painful for Carruthers.

"I'm not an evil, vicious person. I'm not unscrupulous. I'm not uncaring, and I'm not incompetent," Fowler said.

Still, Fowler said Tennessee's lethal-injection protocol needs to change.

He called for fewer handoffs among execution team members and said those responsible for placing IV lines should remain in position to monitor them as the lethal drugs are administered.

"The people who place the IV lines should thereafter be observant about what’s happening with them as the medicine goes in," Fowler said.

Following the failed execution, Tennessee Gov. Bill Lee halted the state's remaining executions for the year and ordered an independent review of what went wrong.

'Homestead' star Bailey Chase says California vaccine plans were 'final straw' that drove family out of LA

"Homestead" star Bailey Chase is opening up about the "final straw" that drove him and his family out of California for a new life in North Carolina.

During a recent interview with Fox News Digital, the 54-year-old actor, who shares daughter Waverly, 12, and 10-year-old twins Maggie and Gauge with his wife Amy, explained that concerns over how California's COVID-19 restrictions would impact his children led him to leave the Golden State behind.

"That happened five years ago in the throes of COVID," Chase said. "My wife and I picked up sticks with our three young children when they were mandating vaccines out there."

"They said they couldn't go back to school without it," Chase, who stars as former Green Beret Jeff Eriksson in "Homestead," continued. "And that was the final straw. And we've been in the mountains of North Carolina ever since living our best life."

Five years after trading Los Angeles for North Carolina, Chase told Fox News Digital that his life now largely revolves around his children's activities when he isn't working.

"I'm like soccer dad right now. It's soccer season, so we're going here and there," he said. "My oldest is really into ballet, and I couldn't be more proud of her and getting ready for ‘The Nutcracker’ in December, and basketball season's around the corner."

While Chase remains committed to his acting career, the "Longmire" alum said his priorities shift completely when he returns home.

"I love my job, and when I'm off filming, I'm 100% focused on that. But when I'm home, I'm home," he said. "There's no greater job than being a dad."

Chase and his family currently live in Amy's hometown of Hendersonville in the Blue Ridge Mountains of Western North Carolina, about 25 miles south of Asheville. Chase has previously explained that Amy had long envisioned eventually returning to the area where she was born and raised. The actor also has ties to North Carolina after attending Duke University in Durham on a football scholarship.

"Amy, being from the mountains of North Carolina, always had it in the back of her mind that she’d go back home one day," he said in a January 2026 interview with Duke Alumni Magazine. "We didn’t know how or when."

However, Chase recalled they decided the time was right due to California's handling of the pandemic.

"Things started to not work in LA during COVID – they shut down the schools, there were no sports for the kids," he said. "Really, no life, no work. And it became more and more obvious that we should leave LA."

"Amy’s very close with her parents, who are in N.C.," he continued. "Everything’s about seven minutes away: school, the in-laws, the grocery store, golf course, soccer field. It’s a great location. We live in a house that would not have been affordable in LA."

"It’s a kid’s dream," he added. "There’s a sports court and a pool. We have two golden retriever puppies, so it’s a full and lively house."

During a February appearance on the "Undaunted.Life: A Man's Podcast," Chase elaborated on the concerns that he had over California's proposed vaccine mandate for his young children's return to school.

"At that time, you know, they're 4, 4 and 6 years old," he recalled. "I got two young girls and, you know we don't need to go down that rabbit hole."

"I was like, 'No, I just don't know enough,'" he continued. "And I got one job right now, and it's to take care of these little nuggets. That's the most important job I have right now."

In October 2021, California Gov. Gavin Newsom announced plans for a COVID-19 vaccine requirement for students that he said would eventually apply to all the state's 6.7 million public and private schoolchildren.

However, the mandate was repeatedly delayed and ultimately never took effect. In February 2023, state health officials announced that they would not pursue or implement the requirement as the COVID-19 state of emergency expired at the end of that month.

Chase previously acknowledged that while relocating to North Carolina was the best move for his family, leaving LA came at a professional cost after he spent 21 years building his career in Hollywood.

"I've lost out on some work by not being in L.A.," he admitted while appearing on the "Living Local" podcast in August.

"There was a big role on 'Grey's Anatomy,'" he continued. "And I understand, it's a lot cheaper for them. They just move on to the next guy and cast someone who's local to L.A."

"But what has happened is I've gotten new opportunities and different kind of jobs and some faith-based films and shows," Chase added.

The "Saving Grace" actor has also spoken openly about how he "lost touch" with God during his years in LA and shared that moving to North Carolina eventually led him back to his Christian faith.

"Moving back here, I've gotten reconnected to my faith," Chase told "Crosswalk" in January. "Just started going to church recently. It took a few years, but I really like the church where we're going to here."

"My cousin started taking us," he continued. "The girls are in youth group. They really love it."

"It's nice to be in an environment where I can openly talk about God and Jesus and without fear of criticism," he added.

In a 2024 Instagram post, Chase reflected on how his priorities have shifted since leaving behind "all that worry, all that stress, 20 years of hustle in LA."

"It also got me thinking if I spent as much time chasing God as I’ve spent chasing success the last 25 years, what would that look like?" he wrote.

Chase is currently starring as former Green Beret Jeff Eriksson in the faith-based streaming platform Angel Studios’ post-apocalyptic drama "Homestead," which will premiere its second season on Nov. 3.

The series follows survivors living at a fortified prepper compound in the Rocky Mountains known as The Homestead after a nuclear attack on LA plunges the country into chaos. After the bomb is detonated, Jeff escapes with his family to The Homestead, where he serves as head of security.

The actor starred in the 2024 theatrical movie "Homestead," which introduces the story and the TV series picks up directly afterward. The cast also includes Neal McDonough, Kevin Lawson Emmanuel McCord, Jesse Hutch, Betzaida Landín, Charles Esten and Dawn Olivieri.

Chase told Fox News Digital that starring in the "Homestead" movie and follow-up TV show had inspired the cast to start prepping for a potential apocalypse.

"'Homestead' has changed all of our lives and the first thing I did when I came home after the film was arm my home more," he said. "And then right before season two, Hurricane Helene hit here in the mountains of North Carolina. And I now have a brand-new generator and some other things."

When asked if most Americans would be able to survive a major disaster, Chase predicted that it would be more challenging for people who live in bigger cities.

"They're overpopulated and there aren't enough resources," he said. "So for those who are a little bit more in the country, their odds are a lot higher."

"Those are the kind of people who hunt and fish and can go out and find their own game," Chase added. "So if I'm laying odds, I'm betting on those guys."

While reflecting on what drew him to "Homestead," Chase explained that his focus on faith and family has also influenced the projects he chooses, noting that the show offers a different message than much of what is coming out of Hollywood.

"I take my job as being a father as the best job and most important job that I'll ever have. And I do take it seriously," Chase told Fox News Digital.

"And how that translates to me being an actor, that's why I'm so proud of ‘Homestead’ and the story that we get to tell, because it reflects my own personal values," he continued. "We got men and women and boys and girls, and it's about promoting faith, family, community and being there for your brother."

"Not all the shows that Hollywood's putting out does that, so I feel truly blessed to be part of a show that delivers a message that I believe in so deeply to my core."

Throughout this race, I’ve said it plainly: whether you voted for Donald Trump, Lindsey Graham, or anyone else, if you care more about your bills than Washington’s political games, this campaign is for you.

I mean it. Last week in Aiken, I stood in a room full of Republicans and independents. One man told me he’d been a Reagan Republican his whole life and had never voted for a Democrat. He came anyway. He wanted to know if I’d actually listen.

I’ve been listening for 18 months on the campaign trail, and for 20 years before that in my exam room.

INDEPENDENT VOTERS AREN’T PICKING A POLITICAL TEAM, THEY JUST FEEL PICKED ON

I didn’t set out to become a politician. I’m a pediatrician and a mom of three. I’ve cared for children whose parents had to choose between groceries and an inhaler, and I’ve taken the 2 a.m. calls from scared moms and dads. Flair was hospitalized late last month after a fall landed him in a Florida hospital. He reportedly fell outside a bar in Tampa, injuring his face and possibly suffering a concussion. He was later seen with an eye patch over the right side of his face.

It’s true that Flair has been through the wringer.

The 16-time WWE champion was badly injured in a plane crash in 1975 but was able to return to the ring just about three months later. He was struck by lightning at least once, though he has claimed he was struck again later in his life. He also said he suffered a heart attack during his final match in 2022 and nearly died in 2017 following his intestines rupturing.

He’s also been open about recent blood clot issues that have hampered his ability to travel more than four hours.

Haley Stevens' endorsement stunt backfires with El-Sayed setting single-day fundraising record

Democratic Senate candidate Abdul El-Sayed’s campaign says it raised more than $2.4 million in a single day, setting a fundraising record in the final stretch of the Michigan race.

The Democratic candidate's campaign said Sunday’s haul came from more than 65,000 donors, who gave an average of $36.74. Nearly 29,600 people contributed to the campaign for the first time.

The fundraising surge came on the heels of Rep. Haley Stevens, D-Mich., endorsing Republican Senate candidate Mike Rogers on Sunday after months of turmoil following her primary loss to the more progressive candidate.

DEMOCRAT HALEY STEVENS ENDORSES GOP SENATE NOMINEE MIKE ROGERS

"As Michiganders head to the polls, the momentum behind Abdul’s campaign has never been stronger," campaign spokesperson Cole Wozniak said in a statement following the final-hour cash haul.

Stevens, who was considered the more moderate establishment candidate in her primary against El-Sayed earlier this year, said she remains "a very proud Democrat" who loves Michigan.

She insisted, however, in the video message posted to social media over the weekend that she could not support El-Sayed, citing his backing from radical left-wing political streamer Hasan Piker.

"Hey Michigan, as you may have seen, our Democratic nominee for U.S. Senate, Abdul said that I was no longer welcome in his campaign and that I should stay away and he's right. And that's why I'm endorsing Mike Rogers for the United States Senate today," Stevens said in a video posted on X.

The endorsement of the Trump-backed Republican candidate drew swift criticism from Democrats.

Senate Minority Leader Chuck Schumer called it "a despicable betrayal" and said his caucus in the upper chamber remains united behind El-Sayed.

Michigan Democratic Party Chair Curtis Hertel also condemned Stevens’ decision, saying she had "abandoned everything she claims to care about."

El-Sayed brushed off the endorsement Sunday, telling reporters he does not think about Stevens or Rogers and was focused on voters and policy.

He also has attempted in recent months to distance himself from Piker amid the streamer's rising national recognition and increased scrutiny on his controversial statements — including antisemitic sentiments and claiming that "America deserved 9/11."

A conservative Jewish activist who was shoved to the ground during a debate at the University of Michigan is speaking out about the violent encounter, vowing not to let the attack silence her.

"It will definitely not dissuade me," Lizzy Benichou told "Fox & Friends" on Monday.

Benichou said she was hosting an open debate on the Ann Arbor campus when a woman approached the group, began shouting and allegedly struck another conservative influencer in the face with her phone before turning on her.

The confrontation escalated as Benichou and fellow conservative influencer Cam Higby challenged the woman over women's freedoms in Iran.

"I think [Higby] said, 'She wouldn't be allowed to be dressed like this,'" she continued.

"I had also said, 'If you were in Iran dressed like this, what would happen to you?' And there were some Jordanian students next to me, and I asked them, 'Am I right?' And then she just lunged."

Benichou described feeling sore after suffering a "hard fall" during the incident Sunday.

In a statement to Fox News Digital, the University of Michigan Police Department confirmed that a student was taken into custody, processed and released, adding that the case "will be forwarded to the Washtenaw County Prosecutor’s Office for review."

The confrontation comes as Michigan's closely watched Senate race brings political and cultural divisions into sharper focus ahead of the midterms.

James Carville makes crude remark about Haley Stevens over shocking Rogers endorsement

Democratic strategist James Carville compared Rep. Haley Stevens, D-Mich., to a "used condom" on the "Politicon" podcast Sunday, hours after she endorsed Republican Mike Rogers.

"I mean, lady, if you're going to sell your soul, you got to get more for it than a f---ing cheeseburger, OK," Carville said. "I'm just telling you that you got to put some kind of a price on yourself for some kind of a g------ self-pride, but your political career is over."

Carville said Stevens' endorsement of Rogers would leave her without support from either party, using a vulgar comparison to describe how he believed Republicans and Democrats viewed her.

"If you think that these Republicans are going to treat you as anything other than what they view you as, and that is, let me just break the news to you, a used condom. The Democrats don't even think you're worth a used condom. But that's about where you are," he continued. "You made your bed, sleep in it. You s--- in your mess kit, eat it."

EL SAYED'S LEFT-WING ALLIES ATTACK 'EVIL' STEVENS AFTER BOMBSHELL ROGERS ENDORSEMENT

Stephen Kent, media director at the Consumer Choice Center, told Fox News Digital that Carville's criticism conflicted with his recent willingness to contemplate Republican victories to limit the influence of democratic socialists.

"Putting aside the gross language, this is ridiculous coming from a guy who just two weeks ago said he'd prefer Republicans hold on to a handful of House seats so that the Democratic Socialist bloc doesn't have too much control of the chamber," Kent said.

"He said after this election, he didn't want to be in the same party as Hasan Piker. So for him to chide Haley Stevens for making the exact same calculus is not shrewd — it's just hypocrisy," he added.

Kent was referring to Carville's recent comments, where the Democratic strategist said he'd rather Republicans win by five seats in the House of Representatives in the midterm elections than Democrats winning by the same number — out of concerns the Democratic Party would become "hostages" to the Democratic Socialists of America.

HASAN PIKER'S INFLUENCE TESTS BREAKING POINT OF DEMOCRATIC PARTY

Stevens endorsed Republican Mike Rogers on Sunday after Democratic nominee Abdul El-Sayed disinvited her from a planned unity event amid a dispute over an advertisement from Rebellion PAC, founded by The Young Turks host Cenk Uygur. The ad linked U.S. military support for Israel to high grocery prices, prompting Stevens to call it antisemitic and demand El-Sayed condemn it.

El-Sayed, who defeated Stevens in their Senate primary, said his campaign did not produce the ad and that he disagreed with its contents.

Far-left streamer Hasan Piker attacked Stevens' motives in a post to X, claiming she was "weirdly obsessed with Israel."

"haley stevens is not the spokesperson for democrats, she’s not the spox for jewish people or black people," Piker said on X. "she's a self interested striver who’s weirdly obsessed with israel and has been paid handsomely for this strange obsession. this race is about solving the affordability crisis, defending democracy, fighting back against the racialized violence all communities have faced since trump came into power and serving michigan. haley and mike rogers serve trump, and trump serves the epstein class. the choice is clear."

"She’s clearly a disturbed, deranged, dishonest woman (less than 48 hours ago she was swearing to the NYT she was backing Abdul)," Zeteo News' editor-in-chief Mehdi Hasan also said on X, going on to attack the Democratic establishment for putting forward a "complete traitor."

FORMER RIVAL DODGES FULL-THROATED EL-SAYED ENDORSEMENT AFTER BITTER SENATE PRIMARY

Former DNC Vice Chair David Hogg also attacked Stevens and urged Democrats to denounce the congresswoman.

"If you supported Haley Stevens now is your time to speak out, denounce her as the Republican she is and apologize for supporting a traitor," Hogg wrote.

In New Zealand, our eyes were fortunate enough to get a look at Te Arai Links for the Asia-Pacific Amateur. While the golf course was the main character, looking like a piece of land that could only be found on a planet not named Earth, Fifa Laopakdee went back-to-back, earning a Masters invite for the second consecutive year.

Novak led the field in strokes gained: putting in both rounds two and three, picking up over 5.6 shots on the greens alone on Friday, posting scores of 61-62. When you shoot 19-under across 36 holes as Novak did, you're going to separate from the field, which is exactly what happened before ultimately earning a five-shot victory.

Steven Fisk and Kristoffer Ventura both shot final rounds of 63 only to lose by five. That has to be quite the feeling.

Novak, who won the 2025 Zurich Classic alongside teammate Ben Griffin, moves up to 53rd in the FedEx Cup Fall standings. Finishing inside the Top 50 is huge, with those players earning spots in full-field and signature events in 2027.

Blades Brown is a big swords guy, allegedly

When your first name is Blades, you're destined to play golf at some level. Blades Brown just so happens to ooze so much talent that he decided to skip out on college, turn professional as a teenager, and earn his PGA Tour card before turning 20.

In order to get to the level Brown has climbed to in such fast fashion, one has to have a team around them, and young Mr. Blades allegedly takes the formation of said team very, very seriously.

Andy Johnson of The Fried Egg has heard a rumor involving Brown and his team, and it may be the greatest thing my 33-year-old ears have ever heard.

During an episode of The Shotgun Start podcast last week, Johnson emphasized that the rumor is unsubstantiated, but that doesn't make it any less incredible.

"Everybody has their teams and everything in golf, your trainer, coaches, your agents, your parents, and I'm hearing that Blades has an interesting aspect to his team," Johnson began. "In order to become a part of the team, you have to get knighted, and you're given a sword. So everyone on his team, whether it's his swing coach, his personal trainer, his agent, they have swords, and they commence and discuss Blades Brown business around a round table.

"Mike Sposa is his equipment guy for Callaway, and he was given a sword, and you become knighted to become part of Blades' team."

Johnson went on to say that it is Brown's parents doing the alleged knighting, which makes it a little less awkward, yet still objectively hilarious.

Blades handing out actual blades to his support staff is the type of golf content we live for.

Fifa Laopakdee gets another go at Augusta National

The Asia-Pacific Amateur may have moved from Dubai to New Zealand, but the winner remained the same.

Thailand's Fifa Laopakdee defended his title at one of the most prestigious amateur events in the world at Te Arai, winning by three shots after a wildly impressive 63 to begin the tournament.

With the victory, Laopakdee earned a spot in both the 2027 Masters and 2027 Open Championship at St. Andrews; not exactly the worst two events to add to the schedule for a college player at Arizona State.

"I feel like I'm more proud of myself this year because I never stopped believing in myself, and even though I had a tough year," Laopakdee said after his victory. "I literally didn't win a single thing since March. I just keep telling myself that I've still got it.

"Shout out to my friends, my family, my coaches, my teammates, that still believe in me and push me hard every day. This win means a lot because I'm able to prove to myself that I've still got it."

"Dutton Ranch" fans are getting a clearer picture of when the series might return.

The "Yellowstone" spinoff focuses on Rip (Cole Hauser) and Beth (Kelly Reilly) following the conclusion of the original saga.

It's become one of Taylor Sheridan's most successful series. Season one premiered in May 2026 and wrapped up on July 3, 2026.

Fans have been eager to know when new episodes will drop, and they're finally moving towards an answer.

"Dutton Ranch" return timeline gets updated.

Deadline reported that Kelly Reilly recently made an unexpected appearance at the Paramount UK Upfronts, and revealed filming will start in early 2027.

Production starting in 2027 means season two will likely premiere at some point in late summer 2027 or fall 2027.

Very little is known about the third prequel to the original neo-Western with Kevin Costner. Given the events of "1883" and "1923," it's highly-likely the main character will be a war veteran and the focus will be defending the ranch.

Monday Morning Pit-Stop is a weekly NASCAR column that runs on OutKick.com and Fox News Digital. If you're looking for a normal NASCAR recap, go check out insufferable ESPN ... assuming they still know NASCAR exists.

And then there was one.

That's right. One race left in this 2026 NASCAR season. Hard to believe. Feels like we just revved engines in Daytona, and now we're taking the checkered flag about 300 miles south in Homestead.

It flew by!

Not really.

Sometimes, it does. Not this year. This NASCAR season has felt like a grind, hasn't it? Some of it was good. Some of it was bad. Some of it was really, really sad.

It's just been a grind.

But that's a topic for next week, when we begin our two months of offseason decompression. For now, we leave Martinsville with everyone pissed at the same dude they've been pissed at all season long ...

Carson Hocevar! In a shocking turn of events, Carson made more enemies on the track yesterday, and I'm not sure even I can defend him this time. I've generally tried to defend Carson most of the season because A) I think he's good for the sport, and B) he's definitely good for this column, but I think he probably deserves whatever he's got coming to him after yesterday.

You'll see.

What else? I've got a nice little ratings rebound at 'Dega after the Phoenix disaster (sort of), Kyle Larson could have the championship wrapped up before the sun goes down next Sunday, and Austin Dillon boards Air Force One with Trump and heads to Daytona.

There are worse ways to spend a Friday, I reckon.

Carson Hocevar did it again

Let's go ahead and congratulate William Byron right off the bat so we can move on to more exciting things.

Byron led a billion laps (362) on his way to absolutely destroying the field yesterday at Martinsville. It was his first win of the season. Chase Elliott finished second. Kyle Larson finished ninth, and now heads to Homestead basically needing to finish the race to win another championship.

Probably won't be quite as exciting as the old Championship Four races, but everyone was so appalled at Joey Logano winning that one time that we got that taken away from us and now we get this.

Oh well.

Anyway, it was a good day for Hendrick Motorsports. Was it the most exciting Martinsville race ever? Lord no. Again, William Byron led 362 (!!!) laps. There wasn't exactly that usual Martinsville drama ...

At the front of the pack.

At the back of it, though? Where Carson Hocevar found himself locked in a tight battle with Austin Cindric?

Yeah, buddy, there was drama:

Nobody loved this move

Amazing. Look, I can't even defend it. That was so hilariously obvious from Carson Hocevar, I don't even know what to say.

He can sit there and feed us the BS "It's just Martinsville" line, but that doesn't quite work in the days of SMT data and instant replay. Not one, not two, not three, but FOUR brake checks before he finally destroyed the No. 2 car.

Just nasty work from Carson. Nasty, nasty work. Austin Cindric, by the way, declined the NBC interview after the race. I'd imagine that means he's keeping his options on the table for next weekend's finale and doesn't want to tip his hand to NASCAR.

Just a guess.

And by the way, for those calling me a drama queen for not siding with Carson here ...

I present to you Kenny Wallace:

"Holyeeee s–t!! I’ve never witnessed anything like this," Wallace tweeted Sunday.

No? Still not good enough for you?

How about Corey LaJoie?

"Good God Almighty," he said.

Two NASCAR drivers — one former, one current — both appalled at whatever the hell that was from Carson Hocevar. And I like Carson! I've defended him a ton this year. I think NASCAR desperately needs a villain, and I think he fills that role nicely.

But Lordy, this was a bad look. Even his own spotter was tired of it yesterday:

"Hey just go. Please? Just go."

Like I said at the jump — it's been a long season. You can hear it in Tyler Green's voice. Don't blame him.

As for the fans ... they weren't pleased, either.

Let's take a look:

Ratings, Trump & Natalie, oh my!

So, there are a ton of fans calling for NASCAR to "park" Carson Hocevar. Feel like that's a bit silly. There's one race left. Feel like this is a spot where NASCAR can let the drivers work it out on the track, no? Who's gonna get in line first next week at Homestead to wreck Carson Hocevar?

Austin Cindric? Ryan Blaney? Brad Keselowski? Zane Smith? He's made so many enemies this year, I've lost count.

Head on a swivel when you get down here, Carson!

OK, let's put the pedal to the floor and get to a couple quickies on the way out. First up?

Last week, we talked about NASCAR's horrific ratings for the Phoenix race a few weeks back (1.2 million). It was awful. I said the folks in marketing should be alarmed by what they saw. Lord knows I was.

For what it's worth, I do have it on good authority that those folks in NASCAR HQ are NOT worried about the number. They believe it's been a decent season, and feel the numbers have been a little off due to Nielsen reporting things a little differently. That's true, by the way.

Nielsen has changed its methodology in reporting. We don't have time to get into it today, but there is some truth to that.

Anyway — as expected — a shift back to NBC and to Talladega got things somewhat back on track last week:

Not bad! 2.5 million. Up 1% from last year. Down from the 3.1 in 2024. On par with everything else the past five years.

Look, it's fine. I'm sure NASCAR was thrilled to get that number back in the 2s. It was the highest-rated race since the season finale at Daytona in August.

Again, though, it was also back on NBC for the first time in months. Network TV was expected to give the Cup Series a much-needed boost, and it delivered. We'll see what Martinsville looks like.

Next? Before we head on out, let's all hop aboard Air Force One with Austin Dillon and get this election week started right!

Pop Pop, for those who couldn't piece it together, is Richard Childress. Those two accompanied Trump to his Daytona rally last Friday. I'm sure liberals handled it well!
