Prosecutors will request Lindsay Lohan’s probation be revoked, could mean serious jail time for actress

Lindsay Lohan could be headed back behind bars. TMZ is reporting and a FOX411 source confirms that the L.A. City Attorney intends to file papers on Wednesday requesting that the troubled actress’s probation be revoked, probation that was instated after she was found guilty in a highly-publicized jewelry theft case last year. Court officials will then set a date for a hearing to formally conclude whether the troubled actress violated the terms of her probation by attracting more criminal charges.

“It is true and she will be notified to hurry and come back to California and will have to appear in court,” a source confirmed to FOX411’s Pop Tarts column. “And there is a good chance she will go to jail this time.”

Lohan is facing up to eight months in jail, which does not include additional jail time if she is convicted in the car accident case.

According to TMZ, the probation violation hearing will be conducted at the same time Lohan stands trial on the charges placed following a June car accident in which she allegedly lied to police. And even if Lohan is found not guilty in the car crash case, the judge can still rule she violated her theft probation because the standard of proving a probation violation is significantly lower than proving guilt beyond a reasonable doubt.

However, the “Liz & Dick” star will likely be nowhere to be seen come Wednesday as she is reportedly off trooping the world on the tour bus of emerging U.K boy band The Wanted. But our well-placed insider insisted that Lohan was not wanted – no pun intended – at the Wednesday arraignment anyway.

“It would do more harm than good if she was there,” said the source, adding that she is not required to be there given that the charges are only misdemeanors.

A legal rep for Lohan did not immediately respond to a request for comment.
