A U.S. man is again challenging an Aruban court ruling that ordered him detained as a suspect in the presumed death of a travel companion, his lawyer said Tuesday.

An appeal was filed Monday with the Court of First Instance of Aruba seeking the immediate release of Gary Giordano, attorney Michael Lopez said.

The appeal also asks that the court consider releasing Giordano at least temporarily pending any trial, Lopez said in a statement. He did not disclose the arguments that he made in the appeal and did not respond to a request for additional comment.

No date has been set for any hearing or a decision on the request.

Giordano is being held on the Dutch Caribbean island as a suspect in the presumed death of 35-year-old Robyn Gardner of Frederick, Maryland.

He has denied any wrongdoing and has told police she was apparently swept out to sea while they were snorkeling off Aruba's southern tip. Her body has not been found.

A judge ruled Aug. 31 that there was enough evidence for authorities to detain Giordano, who is from Gaithersburg, Maryland, for at least 60 days while prosecutors pursue evidence against him. An appeals court upheld that decision a week later.

Solicitor General Taco Stein has said prosecutors will seek to extend the detention order by an additional 30 days when it expires at the end of October.
