A judge has approved a request from artist Mark Rothko's children to move his remains from a Long Island cemetery to a burial plot in Valhalla, N.Y.
The East Marion Cemetery Association voted over a year ago to allow the exhumation, but said it required a court order. State Supreme Court Justice Arthur G. Pitts has now signed that order.
The abstract impressionist painter committed suicide on Feb. 25, 1970.
His children also want to exhume the body of their mother, Mary Alice, from a cemetery in Cleveland. They want to rebury her remains with Rothko in the Kensico Cemetery.
