BELLEFONTAINE, Ohio – A judge has ruled that a recorded police interrogation of an Ohio woman saying she smothered her three young sons can be used during her trial.
The judge ruled Friday that Brittany Pilkington's recorded statements were voluntary.
The court found that the 24-year-old Bellefontaine (behl-FOWN'-tihn) woman's "will was not overborn nor was her capacity for self-discrimination critically impaired" by her statements to police Aug. 18, 2015.
Pilkington has pleaded not guilty to three counts of aggravated murder. She says in the recording that she smothered each boy with a blanket because she didn't want to see them suffering. The boys were killed at different times over 13 months.
Pilkington lawyers argued the statements were obtained unconstitutionally. Her attorney didn't immediately return a call seeking comment Friday.
