BATON ROUGE, La. – A district attorney in Louisiana says he won't prosecute a man whose 8-month-old daughter died after about two hours in a hot car.
East Baton Rouge Parish District Attorney Hillar Moore says Raylee Mercer's death was a tragic accident, and Marvin Mercer's actions don't meet the standard for negligent homicide.
Moore said Monday that evidence shows Raylee was well cared for and not subject to neglect, abuse or mistreatment. He says Mercer has no previous history that suggests he was in any way careless with his children.
Moore says Mercer was supposed to drop Raylee off at day care on his way to work, but forgot she was in the back seat. He notes that 12 to 24 children die in hot cars every year in the United States.
