CHARLESTON, W. Va. – A news report says an 18-year-old Kentucky man has waived extradition so he can be brought to West Virginia to face charges of killing longtime coal executive Ben Hatfield.
The Charleston Gazette-Mail reports (http://bit.ly/1sWbXJr ) Brandon Fitzpatrick waived extradition during a video hearing in front of a Kenton County, Kentucky, judge. Prosecutors don't know yet when Fitzpatrick will be brought to West Virginia to face charges.
Fitzpatrick, who is from Louisa, Kentucky, and 20-year-old Anthony Arriaga, of Lima, Ohio, are both charged with first-degree murder. Fitzpatrick is also charged with conspiracy.
Police say the pair planned on stealing the coal executive's SUV and shot him in the back while he visited a cemetery where his late wife, Debbie, who died from breast cancer in 2009, and other relatives are buried.
