An Ohio judge on Wednesday ordered a hospital to provide to the defense medical records for the man fatally shot by a University of Cincinnati police officer after a traffic stop.
Hamilton County Common Pleas Judge Megan Shanahan granted the defense motion for Good Samaritan Hospital records about Samuel DuBose, including for treatment July 3-7 of last year. The 43-year-old DuBose was shot and killed July 19.
Ray Tensing faces trial Oct. 24 on charges of murder and voluntary manslaughter.
Tensing's attorney, Stewart Mathews, said in his request that he has received information "from several sources" about a medical condition that DuBose was suffering that "may have significant probative value in the defense of this case." He didn't elaborate on the suspected condition.
A message was left Wednesday with a Good Samaritan spokesman in Cincinnati seeking the hospital's response to the order. The order indicates the treatment involved an internal medicine doctor.
Mathews has said Tensing, then 25, feared being dragged under the car as DuBose tried to drive away after the stop near campus for a missing front license plate.
Shanahan scheduled another pretrial hearing for May 10. Tensing has pleaded not guilty and was released last year on $1 million bond.
The university fired Tensing and restructured its public safety leadership. UC and DuBose's family recently reached a $5.3 million settlement that includes free undergraduate tuition for DuBose's 12 children.
The shooting came amid increased attention nationally to how police treat blacks. Tensing is white. DuBose was black.
