NEW YORK – A New York man imprisoned for a quarter century for murder is on track to be freed after a review of his case found his lawyers were never told a key eyewitness initially identified someone else as the killer.
The Brooklyn district attorney's office plans to ask a judge Thursday to overturn Andre Hatchett's conviction. The 49-year-old Hatchett has been serving 25 years to life in the killing of Neda Mae Carter.
She was found dead, naked, beaten and dragged in a park in February 1991.
Prosecutors and Hatchett's lawyers say their review also found other problems.
Among them: Hatchett was on crutches in February 1991, recovering from being shot earlier.
The injuries would have made it difficult for Hatchett to carry out the crime but went unmentioned at trial.
