INDIANAPOLIS – A prosecutor won't pursue criminal charges against the driver of a bus that struck and killed an Indianapolis elementary school principal.
Marion County Prosecutor Terry Curry said Thursday that the driver wasn't impaired by drugs or alcohol and that there's no video of the incident. He says under Indiana law, mere negligence without impairment doesn't constitute a crime.
The accident Jan. 27 on the city's far northeast side killed Amy Beverland Elementary Principal Susan Jordan and injured two students outside the school bus.
Curry says the driver had disengaged the parking brake and shifted the bus to go forward but that the vehicle could not leave because of the location of another bus. He says the bus began to move when the driver stood up from her seat.
