A Maine man with a history of mental illness plans to use an insanity defense when he is tried on charges he mailed cyanide to a man in England who used it to kill himself.
The attorney for 52-year-old Sidney P. Kilmartin filed the notice of the intent to use the insanity defense on Friday in U.S. District Court in Bangor.
The Windham man has pleaded not guilty to charges of mailing cyanide that resulted in the death of Andrew Denton, a depressed 49-year-old man in Hull, England who was found dead on Dec. 31, 2012.
Kilmartin had previously been committed to a psychiatric facility in 2008.
The Portland Press Herald (http://bit.ly/1BREmgr) reports jury selection in the case is scheduled to begin May 5.
