Attorney for Texas father accused of shooting drunken driver says no evidence tied to killing

Investigators say they found a holster and ammunition in the home of a Texas father accused of fatally shooting a drunken driver who killed his two sons in a traffic wreck.

But the father's defense attorney argued at trial Monday that this evidence fails to link the man to the driver's murder.

David Barajas, (bah-RAH'-hahs) is accused of fatally shooting Jose Banda in December 2012 near Alvin, minutes after Banda hit a vehicle Barajas and his two sons had been pushing on a rural road. Twelve-year-old David Jr. and 11-year-old Caleb were killed. Barajas' truck had run out of gas near his home.

Barajas' attorney, Sam Cammack, has told jurors his client did not kill Banda and was focused only on saving his sons.
