Man convicted of killing, raping college student argues to skip sentencing; prosecutor opposed

A judge is set to hear arguments on whether a man convicted of raping and killing a University of New Hampshire student in 2012 can skip his sentencing.

Lawyers for 31-year-old Seth Mazzaglia (muh-ZAY'-lee-uh) will make the argument in a Dover courtroom Tuesday. He was convicted June 27 of first-degree murder and other felonies for killing Elizabeth "Lizzi" Marriott of Westborough, Massachusetts. Prosecutors say he strangled then raped the 19-year-old Marriott in his Dover apartment after she rebuffed his sexual advances.

Mazzaglia's ex-girlfriend, Kathryn McDonough, is already serving jail time for hindering prosecution.

At least 11 family members and friends of Marriott's are expected to give statements at sentencing. In a brief motion filed last week, Mazzaglia said it is his constitutional right to not appear.

Prosecutors oppose the motion.
