Prosecutors in the Colorado theater shootings say the judge shouldn't move the trial out of the suburban Denver county where the massacre occurred in 2012.

In a filing made public Tuesday, prosecutors said it's too early to consider a change of venue. They also said the defense hasn't shown that news coverage has made it impossible to find an impartial jury.

James Holmes is scheduled to go on trial in October on charges of killing 12 people and injuring 70. He pleaded not guilty by reason of insanity. Prosecutors are seeking the death penalty.

Holmes' attorneys say the trial should be moved out of Arapahoe County because potential jurors have been exposed to prejudicial news coverage and carry emotional scars from the massacre.

The judge hasn't said when he'll decide.
