A judge is again denying bond for an Alabama woman charged with capital murder in the running death of her 9-year-old granddaughter.

An Etowah County judge refused to set bond Friday for Joyce Garrard.

Garrard is accused of forcing Savannah Hardin to run for three hours as punishment for a lie about candy two years ago. The girl collapsed and later died.

Meanwhile, the child's father has sued the hospital that treated the girl, Gadsden Regional Medical Center, for malpractice.

The lawsuit claims the hospital failed to properly treat the girl after her collapse. The lawsuit's claims are similar to arguments made in court by Garrard's defense attorney.

A hospital spokeswoman didn't immediately return a message seeking comment.

The girl's stepmother also is charged in her death and is free on bond.
