Nevada Highway Patrol: Trooper didn't fire any shots during encounter with man along road

The Nevada Highway Patrol says a trooper at the scene of a shooting that left a Los Angeles man dead did not fire his weapon.

Trooper Jeremie Elliott said Wednesday that five-year veteran Trooper Lucas Schwarzrock is on paid leave pending a departmental review of the shooting that killed 20-year-old D'Andre Berghardt Jr. during an encounter with authorities.

The federal Bureau of Land Management hasn't identified the two rangers who were involved or released any information about the shooting on Friday on State Route 159 near Red Rock Canyon.

The shooting was captured on a cellphone video taken by a passer-by, but it was unclear who fired the shots that killed Berghardt.

The NHP has said Berghardt was suspected of attacking passing bicyclists on the shoulder of the highway. The video shows Berghardt being shot as he apparently tries to enter an NHP patrol vehicle.
