CONCORD, N.H. – The New Hampshire attorney general's office has decided to forego a retrial for now in the case of a man accused of setting a 1989 fire that killed a family of four.
David McLeod was charged in 2010 with four counts of second-degree murder in the deaths of Carl and Lori Hina; their 4-month-old daughter, Lillian; and Carl Hina's 12-year-old daughter, Sara.
His trial ended in a mistrial Dec. 19 after jurors failed to reach a verdict.
A new trial was scheduled for April 14. On Thursday, Attorney General Joseph Foster said it became clear after a review that included juror interviews that a different outcome after a second trial was highly unlikely.
McLeod's lawyer says supporters are relieved he has finally been released from jail.
