A New Jersey municipal judge who has been told by the state Supreme Court he can't also be a stand-up comedian in his off hours has resigned from the bench.

Vince Sicari tells The Associated Press he tendered his resignation Thursday.

Earlier in the day, the Supreme Court ruled Sicari acting and comedy career "is incompatible" with judicial conduct codes. Appearing as Vince August, the 44-year-old has appeared on network television shows and New York City comedy clubs.

The court noted in its opinion that Sicari's comedy act demeans some people based on religion or national origin and that that could cause some to question his impartiality as a judge.
