One day after the motto "In God We Trust" was placed on the Anderson County Courthouse, a defendant has asked that his charge be dropped because of it.

Kenneth Darrin Fisher of Clinton is charged with trying to kill his wife and illegal weapons possession. His trial is scheduled for March.

According to the Knoxville News Sentinel, the 22-year-old Fisher is of Cherokee descent and his motion states his spiritually follows the "Red Road."

The paper filed Wednesday by his lawyer says the inscription on the courthouse effectively converted the building into what the motion termed "a temple of fundamentalist Christianity," violating the First Amendment.

Anderson County District Attorney General Dave Clark said he is studying the motion before responding.
