An unusual midnight court hearing helped a county prosecutor in Montana avoid spending last weekend in jail.
The Flathead County hearing allowed Deputy Attorney Kenneth "Rusty" Park to be released from custody early Saturday. He was arrested hours earlier on a charge of assaulting a partner or family member.
Normally, a person arrested on Friday night would spend the weekend in jail before receiving a court hearing.
The Daily Inter Lake reports (http://bit.ly/18n4T7N ) sheriff's deputies arrested Park at his Kila home after a woman there said Park was disorderly and throwing things.
Park's attorney, Thane Johnson, called Justice of the Peace Mark Sullivan and Sullivan held an initial appearance hearing after midnight and released Park on his own recognizance.
Flathead County Attorney Ed Corrigan says Park's on paid administrative leave.
