Judge: Expert to decide whether killer gets taxpayer-funded electrolysis

A federal judge who ordered a taxpayer-funded sex change for a convicted murderer is now reportedly forcing Massachusetts’ prison system to pay for an expert to determine whether he needs electrolysis hair-removal treatment.

The Boston Herald reports that U.S. District Court Chief Judge Mark Wolf issued the order Wednesday, instructing the Department of Correction to identify the expert by next month to evaluate Robert Kosilek in order to determine whether electrolysis is medically necessary.

In 2010, a state prison doctor testified that Kosilek, 63, did not need the treatment. That doctor, Robert Deiner, will be called to testify again at a Nov. 19 hearing.

Wolf ordered surgery for Kosilek in a landmark ruling last month. Kosilek, who legally changed his name to Michelle, suffers from gender-identity disorder and sued the state to provide sex-change surgery in 2006. State officials are appealing that decision, arguing that correctional authorities are providing adequate medical treatment.

Kosilek was convicted in 1992 of strangling his wife, Cheryl, and leaving her body at the mall.

Department of Correction officials refused to comment on Wolf’s latest order, the newspaper reports.
