Explosive Anna Nicole Legal Document

This is a partial transcript from "On the Record," February 14, 2007, that has been edited for clarity.

GRETA VAN SUSTEREN, HOST: Now, do you think you have heard all there is to know about Anna Nicole? Well, think again. New accusations about Anna Nicole tonight. The Web site TMZ.com has obtained an explosive legal document written by Anna Nicole Smith's former Nanny. What does it say?

A short time ago, we spoke with TMZ's managing editor, Harvey Levin.

(BEGIN VIDEOTAPE)

VAN SUSTEREN: TMZ.com, your Web site, has some blockbuster information today. One of the things on it is an affidavit from a nanny, is that right, Harvey?

HARVEY LEVIN, TMZ.COM: Yes, it is. It was done in December, when — right after the baby was born. And it really is shocking.

VAN SUSTEREN: What does the affidavit say?

LEVIN: Well, it says a bunch of things. For starters, this nanny is saying that Anna Nicole demanded that the nanny underfeed the baby because she wanted the baby to be — and this is a quote — "sexy." So according to the nanny, Anna Nicole didn't want her to eat enough food, and by the Nanny's eye, the baby was undernourished.

VAN SUSTEREN: All right. Now, the whole affidavit is on TMZ.com. But for the benefit of the viewers who are just listening right now, when did this nanny start working for Anna Nicole?

LEVIN: Just before the baby was born. And you know, the nanny was not there for a long period of time. But what's interesting about it, Greta, is that there are certain stories, two that I know of, that have just recently come out that the nanny talked about back in December. So it kind of gives some credence to the fact that she's not just making all of this stuff up.

VAN SUSTEREN: Did she also talk about Anna Nicole's personal habits?

LEVIN: Well, she talked about a lot of things about Anna Nicole. And the most stunning, I think, is that the nanny says that she tried to commit suicide twice, once by taking sleeping medications, another time by trying to drown herself in a pool. And that pool story is something that did just recently come out through Howard K. Stern. So again, it seems like there's something to what she's saying.

VAN SUSTEREN: Where's this nanny from? Is she from the Bahamas, or is she a foreign national?

LEVIN: I believe she's from — I believe she's from the Bahamas, Greta. I'm not positive.

VAN SUSTEREN: All right. Now, she also talks in her affidavit about the minister of immigration, does she not?

LEVIN: Boy, she does. And she says that she is convinced that they had a sexual relationship, that Anna and the minister had a sexual relationship. She said she never saw them having intercourse, but she says he was there every day in her bedroom for hours. And again, kind of interesting because she made this statement several months before that photograph came out of Anna Nicole in bed with the minister.

And that's really important because there are a lot of people who really question whether Anna Nicole had any right to residency in that country because of the fact that she didn't own a home, really. And you know, this is making things very interesting.

VAN SUSTEREN: I suppose, all and all, the most important thing that the courts will be looking at in this affidavit, though, is the treatment of that baby. Any reference to whether Howard K. Stern was a good father, if, indeed, he is even the father? I know it said that she thought that Anna Nicole was not feeding the baby properly. What about Howard K. Stern?

LEVIN: Well, you know, he was around, but it doesn't seem like he did anything preventative, at least according to the nanny or the affidavit. I mean, I think one the chilling things about this, and I'm not sure I can make sense of it, Greta — when she allegedly tried to commit suicide in the pool and Howard K. Stern got her out, he made some kind of a weird comment that, If you die, you know, I could end up in jail. That's really odd.

VAN SUSTEREN: Very bizarre. All right. Well, the whole affidavit's on TMZ.com, for those who want to read the whole affidavit. Harvey, thank you. It's always nice to see you.
