An evidentiary notice filing was made late Thursday in D.C. Superior Court. Prosecutors alerted Ingmar Guandique's attorneys that they plan to call the witness to testify. Guandique has a hearing set for Friday.

According to the documents, the witness identified Guandique as the man who ran up from behind on a jogging trail, pushed the witness to the ground, then stabbed the witness in the back. The document did not identify the witness or where the attack occurred.

The 27-year-old Guandique is charged with first-degree murder in the slaying of Levy.
