Lawsuit: Doctor, Clinic Wouldn't Operate on HIV-Positive Woman

An advocacy group for people infected with HIV has accused a Fond du Lac medical clinic of discrimination in refusing to perform surgery on a woman with the virus that causes AIDS.

The AIDS Resource Center of Wisconsin says it filed the civil lawsuit in U.S. District Court in Milwaukee on Thursday, naming Dr. Steven M. Cahee, Agnesian HealthCare Inc. and Fond du Lac Regional Clinic as defendants.

The lawsuit alleges the defendants violated state and federal laws in denying gallbladder surgery to 35-year-old Melody Rose.

Peter Kimball of the Resource Center says Rose was an inmate at a state prison in Fond du Lac when doctors referred her to Cahee to have her gallbladder removed. He says another surgeon at a different health care facility eventually did the procedure.

Cahee's office referred requests for comment to Agnesian Health. Its spokeswoman did not immediately return a message.
