A woman behind bars in Ohio for her role in the brutal rape and murder of her 3-year-old daughter wants to be released from prison early because she has terminal cancer.

Fae Evans was found guilty of involuntary manslaughter and child endangerment 15 years ago and sentenced to 13 to 30 years in jail.

Her boyfriend, Ronald Phillips, is on death row for aggravated murder after having been convicted of raping and killing 3-year-old Sheila Marie Evans.

Prosecutors say Sheila suffered terribly from horrific abuse at the hands of 19-year-old Phillips, and her mother, then 26, did nothing to stop him.

When the toddler was brought to the hospital in January 1993, her body was covered in 139 bruises.

"Ronald Phillips had violently beaten Sheila on a Friday night. Had raped her. The child had severe internal injuries," said Summit County Prosecutor Sherri Bevan Walsh. "She was vomiting all weekend. She had diarrhea all weekend. Ultimately, when she died, they discovered that her intestines had gangrene that had set in."

Now, Fae Evans wants to get out of jail because she has a terminal illness — but the prosecutor's office is fighting her release.
