SALT LAKE CITY – A Utah prisoner accused of killing a guard during an escape from a university clinic was warned by a judge Friday to behave in court or face ejection.
Curtis Allgier, joined by defense attorneys and prosecutors, appeared for a brief hearing to discuss a schedule in the case. It was not clear what caused the judge to give the warning.
"I trust when you are in court that you will behave appropriately or I will have you removed from court," 3rd District Judge Dino Himonas said.
Allgier wore handcuffs and his legs were shackled. There were at least nine Salt Lake County sheriff's deputies in the courtroom, including two guarding the door.
Allgier's defense team said it needed more time to look at evidence before setting a schedule. All sides will return to court Sept. 7.
Utah Department of Corrections officer Stephen Anderson, 60, was shot in the head and the chest with his own gun June 25 while trying to stop Allgier from escaping from a University of Utah clinic, police said.
Allgier, 27, was captured about an hour later at an Arby's restaurant. He faces eight charges, including aggravated murder, which could bring the death penalty.
