DAYTONA BEACH, Fla. – A 10-year-old Daytona Beach boy convicted of beating a homeless man will remain in custody until he's no longer deemed a threat to others.
A judge found the boy guilty of aggravated battery last month. The boy, another 10-year-old boy and 17-year-old Jeremy Woods were charged with beating John D'Amico in March as he and a friend walked through a crime-ridden neighborhood.
The judge said the boy sentenced today will be held until psychiatric evaluations show that he is no longer a high or moderate risk to others.
The other young boy has pleaded no contest to misdemeanor battery. Woods is being prosecuted as an adult and could face up to 15 years in prison if convicted.
