Two rottweilers that ripped off a man's ear have been sentenced to death.
Suffolk County Judge Stephen Hackling on Tuesday ordered the two dogs euthanized, but spared the life of a third, a pregnant rottweiler.
After more than two hours of testimony, the judge decided that 1-year-old Cesar and 10-year-old Nina were dangerous.
The dogs' owner, James Mazzone, 44, has 30 days to appeal.
Hackeling said testimony pointed toward Cesar as the aggressor in the June 10 attack. Nina's fate was sealed when it was revealed that she had bitten a man two months ago while he was out hitting golf balls in the same area where the other attack occurred.
The judge said Briska, the pregnant 5-year-old, could return home from the Huntington Town animal shelter in East Northport.
Police say Joe Mortensen, 22, of Dix Hills, was walking his dog with a friend, Chris Green, when they were attacked. Mortensen suffered cuts on his head, and had his ear nearly severed. He underwent surgery at Good Samaritan Hospital in West Islip. Green, of Lake Ronkonkoma, was bitten on the hand.
Mazzone was issued three summonses for not having the dogs licensed. All three dogs had up-to-date rabies vaccinations.
