The Supreme Court refused Monday to revive a lawsuit accusing former Secretary of State Henry Kissinger of responsibility in the 1970 death of the head of the Chilean army.

Family members of Gen. Rene Schneider filed the lawsuit in 2001, claiming that U.S. officials encouraged a plot to kidnap Schneider, in which he was killed.

The suit claimed that the U.S. government and Kissinger, then President Nixon's national security adviser, were guilty of violating U.S., Chilean and international law.

A lower court dismissed the case.

The case is Schneider v. Kissinger, 05-743.
