Why is this case NOT a slam dunk for the prosecution?

Greta: First of all, they don’t have a murder weapon. They don’t have a murder scene. They don’t even know when the murder occurred! What are some things we should keep an eye out for as the case progresses?

Greta: The defense is going to constantly be looking for problems in the prosecution’s case — inconsistencies that don’t make sense. What the prosecution is going to try to do is tie Scott Peterson to the murder, and it’s an uphill battle for both sides. What makes this so intriguing is that it is not a slam dunk for either side. Any surprises in the courtroom?

Greta: I was surprised at a mistake the prosecutor made in his opening statement. He said Scott lied about what he was doing on December 24th and told police he was home watching a Martha Stewart show with Laci. They said, “well what Martha Stewart show?” And Scott said, “I don’t know. One with meringue in it or something.” The detective got a copy of the show, and concluded that there was no meringue in the show. The prosecutor used that in the opening statement to say that Scott was basically a liar. Then defense attorney Mark Geragos stood up and displayed the Martha Stewart segment in question to show that the detective was wrong. The prosecutor looked bad because he never bothered to double-check his detective. Now that is not fatal to the case, but a prosecutor doesn’t want to start out on a sloppy foot.
What is your overall sense of this trial?

Greta: I don’t know if Scott will be convicted. Sometimes even when someone is guilty the prosecution doesn’t have the evidence to convict the person, and then sometimes the person isn’t guilty at all. That’s what is so intriguing about this case. There are a lot of twists and turns. If you just listen to the media you would see some of the highlights, but there is a lot more to it than that. You’ve had dozens of exclusives on this story. What are some key things that you are excited about for your show?

Greta: What I like most about it is that we are actually in the courtroom, so we get to talk to people; we get to talk to family members, we get to talk to the lawyers involved in the case. When you actually come out and cover a case, you walk the place, and you get to know it. I’ve been to the Berkeley marina, which is where Scott says he was on December 24. I’ve actually been inside Laci and Scott's home. I’ve walked the park where the defense says Laci was that day. I’ve been to the warehouse where the boat was. We’ve been to all those places, and we’ve brought cameras to those places. What we can do that other shows can’t is bring you right to the spot.
