LOS ANGELES – A Superior Court judge on Tuesday ordered actor Tom Sizemore (search) to appear in court Aug. 5 to set another hearing into whether he violated probation after being convicted of abusing ex-girlfriend and former Hollywood madam Heidi Fleiss (search).
Prosecutors allege he made contact with Fleiss and tested positive for drugs, said Frank Mateljan, a spokesman for the Los Angeles City Attorney's Office.
Sizemore's attorney, Michael Rovell, said he expected the hearing to last no more than five minutes. The actor, who will attend, is doing well and did not violate his probation, Rovell said.
Sizemore, who has appeared in such films as "Black Hawk Down" (search) and "Saving Private Ryan," was sentenced in October to six months in jail on misdemeanor charges of harassing, annoying and physically abusing Fleiss during the two years they were together.
Superior Court Judge Antonio Barreto Jr. stayed the jail time while Sizemore took part in a rehabilitation program for drug abusers, and the judge said he would consider reducing the sentence to 90 days if the actor successfully completed the program and other requirements.
Sizemore also was ordered to stay away from Fleiss and to undergo counseling for domestic violence and anger management. His probation terms also called for regular drug testing.
Rovell said Sizemore has been busy shooting a TV show and working on the TV film "Hustle," about the life of baseball great Pete Rose.
"He's a superb actor," Rovell said. "I had the privilege of seeing some of the scenes. ... He has Pete Rose down unbelievable. He's really, really good.
"His film persona is as a tough guy, but he's a very sensitive, a very genuine human being," Rovell added. "He just had a bad choice of girlfriend, that's all."
