AUSTIN, Texas – Rep. Ciro Rodriguez (search) went to the Texas Supreme Court with vote-tampering allegations Monday in a bid to have his 58-vote loss in the Democratic primary overturned.
Rodriguez, a seven-year congressman from San Antonio, led by 145 votes on election night in March. But opponent Henry Cuellar (search) took the lead in a recount after more than 200 previously untallied ballots were discovered.
Rodriguez sued, alleging irregularities in the casting, counting and recounting of ballots. He claimed that some voters did not even live in the district, and some gave false information in order to cast ballots.
Bob Heath, Cuellar's attorney, said of Rodriguez's challenge: "I think it's time to move on."
