Hi, I'm Bill O'Reilly. Thanks for watching us tonight.
Why are some Americans hindering the war on terror? That is the subject of this evening's "Talking Points Memo." As we predicted, President Bush's poll numbers have gone up after last week's press conference. The elite media wanted Mr. Bush to grovel, but he remains defiant and determined to fight the terror war his way.
That kind of resolve is appealing to many Americans. Thus the gresident gained from his chat with the press.
Today the Supreme Court (search) heard arguments that the prisoners at Guantanamo Bay (search) should have lawyers and due process. Six hundred men from 44 countries have been held for more than two years without such rights. That's because the Bush administration has designated them illegal battlefield combatants, meaning they have no rights at all. They can be held indefinitely outside the U.S.A.
The other side says Guantanamo Bay is a part of America because the government rents it. And that's what the Supreme Court will decide, whether our constitutional protections extend to these people on the technicality that they're on U.S. soil.
But the real issue here is human rights. Predictably, "The New YorkTimes" wants lawyers for the accused terrorists, editorializing that some of them "may have been in the wrong place at the wrong time."
Sure. They just took a wrong turn into Uzbekistan and wandered onto the battlefield. How ridiculous is that? Anybody winding up in Gitmo is vetted twice by the U.S. military inside Afghanistan and was on the battlefield illegally, meaning they were not Afghans. They were either armed terrorists or aiding armed terrorists.
This wrong place stuff is absurd, but the Bush administration enables this kind of nonsense because it basically doesn't put forth a plan. What would be wrong with trying these people in a U.S. military court? At least that way, there would be some kind of definition of who they are and what they did. Some kind of justice procedure would be in place.
For now, the Supreme Court will probably rule that these illegal combatants, terrorists, are not entitled to the same rights you and I enjoy, but the human rights question will not go away. Let's hand these Gitmo detainees over to the military courts and avoid giving our enemies, both here and abroad more ammunition.

One of the main complaints we get on billoreilly.com and on The Factor Web site is that there's a shortage of stuff for the ladies, as far as gear is concerned. -- Thongs are out, of course, as are shoes. -- Don't want to get involved with that. -- But we did come up with a "Spin Stops Here" bag that is perfect for Mother'sDay. Look at that. You can throw all kinds of stuff in there. Also put a signed copy of "Those Who Trespass" in the front pocket and a gigantic beach towel if you want to throw it over the guy.
