Tonight... The O'Reilly Factor is on!

The coroner investigating the death of 41-year-old Nathaniel Jones (search), who died in police custody after a struggle with law enforcement officials outside a Cincinnati fastfood restaurant, has determined that the man's death was a homicide.

We'll have the details on the Hamilton County coroner's report and we'll discuss the case with WDBZ radio talk show host Lincoln Ware.

Then, Scott Peterson (search) was back in court today. The man accused of murdering his wife and unborn child pleaded innocent and a judge set his trial date for Monday, January 26. How important will blood evidence be in the trial? We'll have the latest from Modesto, California when our Rita Cosby joins us.

Plus, our "mole" was there last night at a big meeting in Hollywood where liberal Democrats held a strategy session designed to figure out a way to prevent President Bush from being re-elected in 2004. More than 200 members of the Tinseltown elite attended the meeting.  Our guy will fill us in on what happened.

Finally, don't miss our famous Talking Points Memo and The Most Ridiculous Item of the Day!
