Extraordinary Rendition

" CIA violated the constitution. It's a question we're asking tonight after an Italian court convicted more than twenty US operatives for conducting an illegal mission on Italian soil. The court sentenced 23 people in absentia. For the 2003. Abduction of an Egyptian Muslim cleric in Milan Italy. But cleric says he was kidnapped and brought to another country where -- was tortured. Here now to talk about this case is -- German. He's a former FBI agent and undercover agent for the FBI who now works for the ACLU and he's an author of the author of thinking. Like a terrorist -- welcome to the Glenn Beck program so did these CIA agents violate. American law did they violate the constitution. And should they have been prosecuted and convicted as they work."

" Certainly they did yeah the Fifth Amendment and they -- If that ended the Fifth Amendment -- requires that due process before somebody is deprived -- later liberty. So clearly this was it was a violation also violation of the convention again."

" Torture which the US is signatory to the right through it could be a violent these American and Italian agents I've got a prosecutor. I had to get a search warrant for the arrest warrant. Ironically the same prosecutor that five years later would prosecute them. The arrest warrant was to arrest this cleric they executed the arrest warrant but instead of delivering into an Italian jail. They flew into an American air base and then -- to Germany. And then flew on to Egypt where he says he was tortured. And then they overheard whatever he said. Under torture and then they went and spent a 140000. Dollars at a hotel. At Lake Como in northern Italy. And then they were tried in absentia. Should they be tried in a foreign court or should the American government have tried them for breaking -- laws."

" I think the American government certainly should have taking care of this mess from the very beginning and -- that debt I think the fact that they won't the idea that we don't wanna look back is what. It you know kind of force -- the Italians to to take some action try to make sure that we are following the -- And it debt that is actually you know something that protects us off. So I think that this should be a wake up call for the American government that we have to take a look at -- all these practices. And hold the people who who who not just of the debt the low level people who who effectuate the policy but the people who. Created the policy and and ordered these people to do."

On federal reservations and obviously would have jurisdiction for for any. You know ties that that may go off the military.
