Sotomayor Nomination

" Democrats are hoping for quick confirmation but could the recent Republican outrage over what they call Sonia Sotomayor -- job discrimination. Tom -- is a former Justice Department official for the bush administration and joins us now. Comments are coming in today vacation. Of course a lot of press this week over the case that she was involved with the with the white firefighters at a New Haven, Connecticut tops on the promotions it seems that they didn't get promoted the city was worried that other minority candidates had done as well. They want at the Supreme Court this week overturning -- Meyer's decision the second circuit. Do you really think that'll be enough to it's in -- they give for a major bump in the road."

" Commission hearings it's hard to see this decision -- mailing the Sotomayor nomination but clearly what happened -- the Supreme Court so that she was wrong. They decided case by 54 margin analysts there were four justices that more or less agree with what judge Sotomayor said. Certainly it's a worrisome decision I think it's troubling from a conservative perspective that the Supreme Court has said she's wrong. I would imagine that senators will ask judge Sotomayor a fair amount about that decision in -- confirmation it's."

" What does it to -- Friday afternoon we got word that 71 new documents had been turned in where she's responding to Senate Judiciary Committee questionnaire. I spent Friday afternoon and evening going -- those -- from the Puerto Rican legal defense and education -- a lot of people think that's a very conservative. Very liberal political group and they weren't involved as I read it in a number of cases that -- discrimination issues. And that we're actually trying to help these minority candidate to -- and while police and -- and were trying to force affirmative action quotas and other things. She was a member of the group at that time she was also heading up the litigation department. In the eighties with that organization. Do you think -- to that group are gonna hurt her at all in a major way. Well so far --"

" We haven't seen anything that suggests she's anything other than as advertised that is to say. There's no question she has a pretty liberal political view on some issues particularly issues such as discrimination -- affirmative action. So from that perspective I don't think there's going to be a dramatic shift in public opinion based on this new documents. At the same time I certainly think that the Senate will ask about it there's no question that -- Sotomayor has very long track record both as a judge and -- for finding out. As a litigator -- well."

" That's actually right now it used to be that when a nominee would come up in this spent four hours he's -- hearings in the Senate was all that abortion I mean with the number one Roe vs. Wade and certainly she'd you know senators that -- visited with sensitive asked about that. But a lot of folks are saying gun rights in the Second Amendment -- the new Roe vs. Wade and that she's gonna face a lot of questioning about that when she's on the hill as well. The case that she was involved in -- the second circuit the Maloney case. In which she held that states can't be an under ownership of certain guns -- weapons. Has now -- appealed to the Supreme Court could land there while she sitting on the bench if she's confirmed how much do you think that they figure into the confirmation hearings this while."

" I think a lot people are going to be focusing on the Second Amendment -- there's no question that there's the case you mention their other cases that are right now in the lower courts. And are percolating up the Supreme Court -- if you look at and say 567. Major issues of constitutional law that are going to be presented to the Supreme Court in the next year next two years. Second Amendment gun control gun rights definitely at the top analyst."

" Republicans are saying is still so much they don't know with these document dumps that are coming in of course that's going to be their -- gonna wanna push that this is going to quickly Democrats say. It's on track to expect any change in the calendar means and kicking off in just over week."

" The Democrats are fast track and there's no question is scheduled a hearing to begin a week from Monday. That's pretty fast -- particularly fast given the volume of documents that we've seen it's I can tell you that there are a lot of folks on Capitol Hill and elsewhere who have been spending a lot of time like you had. Going through the Sotomayor paper trail trying to find decisions. Legal brief speeches really anything that is insight into how it justice Sotomayor would think about approached the law and the constitution.
